Allgemeine Geschäftsbedingungen
für “Sword Art Online -EX-CHRONICLE- Online Edition”


Diese Allgemeinen Geschäftsbedingungen für “Sword Art Online -EX-CHRONICLE- Online Edition” ("Bedingungen") legen die Bedingungen für die Nutzung des Dienstes “Sword Art Online -EX-CHRONICLE- Online Edition” ("Leistung") fest, der von Sony Music Solutions Inc. ("Sony") für Kunden im Leistungsbereich ("Kunde") bereitgestellt wird.
Sony kann gesonderte Bedingungen im Zusammenhang mit der Leistung festlegen (u.a. Nutzungsbedingungen, die zusätzlich auf Teile der Leistung anzuwenden sind, Betriebsregeln, die innerhalb der Leistung gesondert bekannt zu geben sind) ("Einzelbedingungen"; diese gelten als Teil dieser Bedingungen, sofern nicht ausdrücklich auf sie Bezug genommen wird), der Kunde hat die Leistung auch entsprechend den Einzelbedingungen zu nutzen. Bei Widersprüchen zwischen diesen Bedingungen und den Einzelbedingungen oder den Inhalten anderer Websites haben diese Bedingungen Vorrang, sofern nicht anders angegeben.
Die Nutzer der Leistung müssen nach der jeweils anwendbaren Rechtsordnung volljährig sein.
1. Service
1-1 Zugehörige Daten und Dokumente usw. sowie deren aktualisierte/erweiterte Versionen sind ebenfalls Bestandteil dieser Leistung.
1-2 Sony kann überall innerhalb dieser Leistung Werbung für Sony und/oder Dritte schalten.
1-3 Für die Nutzung dieser Leistung ist ein Internetzugang erforderlich. Der Kunde ist für die Einrichtung und Aufrechterhaltung eines solchen Internetzugangs auf eigene Kosten, einschließlich der Übernahme von Kommunikationskosten und den Kosten für die Gewährleistung der Netzwerksicherheit, selbst verantwortlich.
1-4 Die Leistung ist nicht dazu bestimmt, zum Zwecke der Datensicherung oder Datenspeicherung verwendet zu werden. Sony haftet in keiner Weise für den Verlust, die Änderung oder Ähnlichem von in den Leistungen enthaltenen Daten oder für die Unmöglichkeit, auf die in den Leistungen enthaltenen Daten zuzugreifen, diese zu verwenden, hoch- oder herunterzuladen, es sei denn, dass von Kunden erworbene Eintrittskarten usw. aus Gründen, die Sony zu vertreten hat, verloren gehen oder in sonstiger Weise nicht mehr verwendet werden können; weiterhin haftet Sony auch nicht im Falle der Löschung eines Benutzerkontos oder für die Änderung, Unterbrechung oder Beendigung der Leistung.
1-5 Teile der Leistung können gegen eine Gebühr erbracht werden, Preise und Zahlungsbedingungen werden auf der Website der Leistung bekannt gegeben. Sofern nicht gesetzlich vorgeschrieben, werden für die Leistung gezahlte Gebühren nicht zurückerstattet.
2. Benutzerkonto
2-1 Um die Leistung zu nutzen, muss der Kunde die erforderlichen Daten Sony ordnungsgemäß zur Verfügung stellen und ein Benutzerkonto ("Konto") erstellen. Der Kunde kann ein Konto auch unter Verwendung eines von Sony zugelassenen Drittanbieterkontos erstellen. Wenn Sony der Ansicht ist, dass einer der folgenden Punkte zutrifft oder die Erbringung der Leistung in sonstiger Weise unmöglich oder unangemessen ist, kann Sony die Erstellung eines Kontos ablehnen, das bereits erstellte Konto löschen oder weitere Maßnahmen ergreifen, die Sony für angemessen hält:
(1) Wenn der Kunde ein Minderjähriger im Leistungsbereich ist;
(2) Wenn der Kunde Sony Daten zur Verfügung stellt, die nicht den Tatsachen entsprechen, wie z.B. die Verwendung des Namens einer anderen Person oder die Abgabe einer falschen Erklärung;
(3) Wenn der Kunde während der Nutzung der Leistung oder in der Vergangenheit gegen diese Bedingungen oder gegen geltende Gesetze und Vorschriften verstoßen hat;
(4) I Wenn auf den Kunden eine der folgenden Eigenschaften zutrifft: Er selbst eine organisierte kriminelle Vereinigung oder ein Mitglied einer organisierten kriminellen Vereinigung ist; er in den letzten fünf Jahren Mitglied einer organisierten kriminellen Vereinigung war oder er mit einer organisierten kriminellen Vereinigung in Verbindung steht; wenn er selbst Erpresser ist oder einer Gruppierung, die kriminelle Aktivitäten unter dem Vorwand der Durchführung sozialer Kampagnen durchführt, einer kriminellen Gruppe, die sich auf intellektuelle Verbrechen spezialisiert hat, etc. angehört; er eine den genannten Personen gleichzustellende Person ist; er eine Person ist, welche von der japanischen Regierung oder einer ausländischen Regierung mit Wirtschaftssanktionen belegt wurde, oder eine Person ist, die in einem Land oder einer Region ansässig ist, das/die von der japanischen Regierung oder ausländischen Regierungen mit Wirtschaftssanktionen belegt wurde (zusammenfassend "antisoziale Kräfte"), oder eine juristische Person ist, die solche antisoziale Kräfte in Führungspositionen beschäftigt;
(5) Wenn der Kunde bereits zuvor ein Konto erstellt hat.
2-2 Werden Daten, die der Kunde Sony im Zusammenhang mit der Nutzung der Leistung zur Verfügung gestellt hat, geändert, so hat der Kunde das Änderungsverfahren unverzüglich in der von Sony vorgeschriebenen Weise durchzuführen.
2-3 Der Kunde darf das Konto eines anderen Kunden nicht zur Nutzung der Leistung verwenden und darf Dritten auch nicht gestatten, das Konto dieses Kunden zu verwenden.
2-4 Der Kunde ist verpflichtet, die Informationen in Bezug auf sein eigenes Konto, einschließlich der ID und des Passworts, ordnungsgemäß zu behandeln. Der Kunde ist für alle Handlungen und Folgen der Nutzung der Leistung unter seinem eigenen Konto verantwortlich.
2-5 Der Kunde kann die Nutzung der Leistung jederzeit beenden (das Kundenkonto löschen), und zwar durch das von Sony vorgeschriebene Verfahren. Mit der Beendigung verliert der Kunde alle Rechte aus diesen Bedingungen; diese Bedingungen gelten jedoch auch nach einer solchen Beendigung weiterhin für solche Angelegenheiten, die mit der Nutzung der Leistung durch den Kunden vor der Beendigung zusammenhängen.
3. Datenschutz
Die von Sony im Zusammenhang mit der Leistung erworbenen Daten des Kunden werden in Übereinstimmung mit der Datenschutzerklärung von Sony verarbeitet und ausgewertet.
4. Verbotene Handlungen
4-1 Bei der Nutzung der Leistung darf der Kunde keine der folgenden Handlungen versuchen oder vornehmen und darf auch nicht an solchen Handlungen Dritter mitwirken oder diese fördern:
(1) Verletzung der Rechte oder rechtlich geschützten Interessen (einschließlich geistiger Eigentumsrechte, Geschäftsgeheimnisse, Ehre des Einzelnen, Datenschutzrechte, Recht am eignen Bild, Werberechte und sonstige Eigentumsrechte) von Sony oder Dritten;
(2) Verstoß gegen Gesetze, Verordnungen, Gerichtsentscheidungen oder sonstige rechtsverbindliche Anordnungen der öffentlichen Verwaltung oder Verstoß gegen die öffentliche Ordnung und Moral;
(3) Beleidigung, Verleumdung, üble Nachrede gegenüber Sony oder Dritten im öffentlichen Bereich der Leistung oder durch das Hochladen oder Übertragen von Äußerungen oder sonstigen Informationen mit beleidigendem oder antisozialem Inhalt (einschließlich Äußerungen, die übermäßig gewalttätig oder ausdrücklich sexuell sind oder zu Diskriminierung führen können) oder auf sonstige Weise;
(4) Mobbing, Belästigung oder jede andere Handlung, die die reibungslose Nutzung der Leistung durch andere Kunden behindern (einschließlich des Versendens von falschen Informationen oder Spam oder der Störung der Kommunikation anderer Kunden);
(5) Unerlaubtes Sammeln, Verwenden, Offenlegen, Bereitstellen oder anderweitiges Zugänglichmachen für Dritte von persönlichen Informationen, anderen datenschutzrelevanten Informationen oder vertraulichen Informationen wie Passwörtern anderer;
(6) Die Verwendung der Leistung zu Gewinnerzielungszwecken (es sei denn, Sony hat dies im Voraus schriftlich genehmigt), zum Treffen oder zur Kontaktaufnahme mit Fremden des anderen Geschlechts oder zur Vornahme von Handlungen zu sonstigen Zwecken, die vom beabsichtigten Zweck der Leistung abweichen;
(7) Das Herunterladen, die Verbreitung, die Bereitstellung zur öffentlichen Übertragung, die Änderung, der Betrieb, die Nachkonstruktion, die Dekompilierung, die Zerlegung, die Löschung usw. der gesamten Leistung oder eines Teils der Leistung über den von Sony ausdrücklich genehmigten Umfang hinaus (einschließlich des Falles der Deaktivierung oder Umgehung von Funktionen wie Inhaltsschutz und Zugriffskontrolle oder der vorsätzlichen missbräuchlichen Verwendung von Systemfehlern der Leistung);
(8) Das Einbringen oder Ausführen von Viren oder sonstigen Programmen oder Dateien, die den ordnungsgemäßen Betrieb von Informationsterminals, Netzwerkvorrichtungen, Systemen usw., die von Sony oder Dritten verwaltet werden, in oder auf solchen Informationsterminals usw. stören, deren Betrieb behindern/kontrollieren oder deren Daten durchsuchen/erwerben oder beschädigen;
(9) Beeinträchtigung des normalen und reibungslosen Betriebs der Leistung, indem z.B. der Server der Leistung übermäßig belastet wird oder indem übermäßige Anfragen gestellt werden, die über den Rahmen der rechtmäßigen Ausübung der Rechte gemäß diesen Bedingungen hinausgehen;
(10) Jede andere Verletzung dieser Bedingungen; oder
(11) Sonstige vergleichbare Angelegenheiten, die von Sony als unangemessen erachtet werden
4-2 Sollte Sony feststellen, dass der Kunde gegen diese Bedingungen verstößt, ist Sony berechtigt, das Konto des jeweiligen Kunden zeitweise stillzulegen oder zu löschen.
4-3 Sofern nicht anderweitig gesetzlich vorgeschrieben, ist Sony nicht verpflichtet, die Online-Aktivitäten des Kunden bei Nutzung der Leistung zu überwachen. Soweit es gesetzlich zulässig ist und einem rechtmäßigen Zweck dient, wie z.B. zur Sicherstellung der Einhaltung der geltenden Gesetze und dieser Bedingungen, darf Sony in dem erlaubten Umfang Online-Aktivitäten bei der Nutzung der Leistung aufzeichnen sowie diese durchsuchen und offenlegen.
5. Rechte an geistigem Eigentum
5-1 Rechte an geistigem Eigentum und sonstige Rechte im Zusammenhang mit der Leistung stehen im Eigentum oder unter der Kontrolle von Sony oder dem ursprünglichen Rechteinhaber, der Sony eine Lizenz erteilt hat ("ursprünglicher Rechteinhaber").
5-2 Die Leistung kann Software enthalten, für die der ursprüngliche Rechteinhaber andere Nutzungsbedingungen als diese Bedingungen festgelegt hat. Gibt Sony solche Nutzungsbedingungen innerhalb der Leistung bekannt, so hat der Kunde die Leistung auch in Übereinstimmung mit diesen Nutzungsbedingungen zu nutzen.
5-3 Der Kunde gewährt Sony hiermit das nicht ausschließliche Recht (mit dem Recht auf Vergabe von Unterlizenzen) zur Verwendung von Bild-, Ton-, Text- oder sonstigen Informationen, die vom Kunden in Verbindung mit der Nutzung der Leistung eingestellt oder übertragen werden ("Veröffentlichter Content") (eine solche Verwendung schließt die Vervielfältigung, den Vertrieb, die öffentliche Übertragung, das teilweise Weglassen und sonstige Anpassungen ein), und zwar im gesamten Bereich der Leistung, und zwar unentgeltlich durch Sony oder eine von Sony benannten Dritten, soweit dies nach den geltenden Gesetzen zulässig ist. Der Kunde erklärt sich ferner damit einverstanden, auf jegliche Urheberpersönlichkeitsrechte in Bezug auf den Veröffentlichten Content zu verzichten bzw. diese nicht auszuüben. Es obliegt dem Kunden zu bestätigen, dass der Veröffentlichte Content nicht gegen die Rechte Dritter verstößt und im Übrigen mit dem Inhalt dieser Bedingungen übereinstimmt.
5-4 Sony ist berechtigt, ohne Benachrichtigung des Kunden, jedwede Maßnahmen zu ergreifen, einschließlich der Löschung von auf der Leistung Veröffentlichtem Content, für den Fall, das Sony der Ansicht ist, dass der betreffende Veröffentlichte Content gegen diese Bedingungen verstößt oder unangemessen ist. Sony haftet dem Kunden gegenüber nicht für derartige Maßnahmen.
6. Änderung, Aussetzung, Beendigung der Leistung
6-1 Sony ist berechtigt, die Leistung nach eigenem Ermessen ganz oder teilweise zu ändern, wenn die Erbringung der Leistung durch eine solche Änderung nicht oder nicht wesentlich beeinträchtigt wird. Im Zusammenhang mit solchen Änderungen kann es erforderlich sein, dass der Kunde die Leistung, einschließlich der dazugehörigen Software, als Voraussetzung für die weitere Nutzung der Leistung aktualisiert.
6-2 Sony ist berechtigt, die Erbringung der Leistung ganz oder teilweise für den erforderlichen Zeitraum auszusetzen, wenn einer der folgenden Fälle vorliegt:
(1) Wenn eine Unterbrechung bei der Erbringung von Leistungen Dritter (insbesondere Telekommunikationsleistungen und Cloud-Leistungen) vorliegt, die für die Erbringung der Leistung erforderlich sind;
(2) Wenn es notwendig ist, die Leistung zu unterbrechen, um eine Wartung und/oder Inspektion des für die Bereitstellung der Leistung erforderlichen Systems durchzuführen oder um dessen Ausfall, Defekt usw. zu beheben;
(3) Wenn die Leistung aufgrund eines Stromausfalls, einer Naturkatastrophe, eines Streiks oder eines sonstigen Ereignisses höherer Gewalt nicht erbracht werden kann; oder
(4) Wenn Sony es für unvermeidbar hält.
6-3 Außer in Notfällen wird Sony den Kunden vor einer Änderung, Aussetzung oder Beendigung der gesamten Leistung oder eines Teils davon benachrichtigen, wenn eine solche Änderung, Aussetzung oder Beendigung erhebliche Auswirkungen auf den Kunden hat.
7. Haftungsausschluss
7-1 Sofern dies nicht durch geltende Gesetze untersagt ist, gibt Sony keine ausdrückliche oder stillschweigende Zusicherung oder Gewährleistung in Bezug auf die Richtigkeit, Sicherheit und sonstige Angelegenheiten des Inhalts von Websites und Leistungen Dritter, auf die über einen Link von der Leistung aus zugegriffen werden kann, einschließlich Werbung auf der Leistung, ab. Sony haftet nicht für Schäden oder sonstige Folgen, die sich aus der Verwendung solcher Websites oder Leistungen durch den Kunden ergeben.
7-2 Entstehen zwischen dem Kunden und einem Dritten Streitigkeiten aufgrund der Verletzung von Rechten oder aus sonstigen Gründen die im Zusammenhang mit der Nutzung der Leistung durch den Kunden stehen, so hat der Kunde diese Streitigkeiten auf eigene Kosten und Verantwortung beizulegen, wobei Sony in keiner Weise hierfür haftbar gemacht werden kann.
7-3 Die Leistung wird dem Kunden von Sony im Rahmen des Vertrages zwischen Sony und dem Kunden auf der Grundlage dieser Bedingungen erbracht, und der ursprüngliche Rechteinhaber haftet dem Kunden gegenüber in keiner Weise hinsichtlich der Leistung, sofern nicht gesetzlich etwas anderes bestimmt ist.
8. Begrenzung der Haftung
8-1 Sony haftet für Schadensersatzansprüche, gleich aus welchem Rechtsgrund, insbesondere wegen Verletzung von Pflichten aus dem Schuldverhältnis und aus unerlaubter Handlung, nur in den folgenden Fällen:
a) vorsätzliches Fehlverhalten;
b) Verletzung von Leben, Körper und Gesundheit;
c) bei Nichteinhaltung einer ausdrücklich übernommenen Garantie;
d) wenn in anderen Fällen eine verschuldensunabhängige Haftung nach den gesetzlichen Bestimmungen vorgesehen ist;
e) bei grober Fahrlässigkeit; und/oder
f) im Falle der Verletzung einer wesentlichen Pflicht; Im Übrigen ist die Haftung von Sony ausgeschlossen. Eine "Wesentliche Pflicht" im Sinne dieses Vertrages ist (i) jede Vertragspflicht, die eine wesentliche Vertragsposition schützt, deren Gewährung ein wesentliches Ziel und einen wesentlichen Zweck des Vertrages darstellt, und/oder (ii) jede Vertragspflicht, deren Erfüllung die ordnungsgemäße Durchführung der Leistung überhaupt erst ermöglicht und auf deren Erfüllung die Vertragsparteien regelmäßig vertrauen dürfen.
8-2 In den Fällen der Ziffer 8.1 d) bis f) haftet Sony nur für den typischen und vorhersehbaren Schaden.
8-3 Die Haftungsausschlüsse bzw. -beschränkungen gelten in gleichem Maße auch für Handlungen der gesetzlichen Vertreter, leitenden und nichtleitenden Angestellten und sonstigen Erfüllungsgehilfen von Sony sowie von Subunternehmern. Sony übernimmt keine Haftung für Mitarbeiter oder sonstige Hilfspersonen, die bei der Erfüllung der vertraglichen Pflichten durch den Kunden eingesetzt werden, und der Kunde stellt Sony von allen Aufwendungen und Ansprüchen Dritter für Schäden dieser Personen frei. Dies gilt nicht, wenn es sich bei diesen Personen um Hilfspersonen von Sony handelt.
8-4 Die vorgenannten Bestimmungen sind nicht als Umkehr der Beweislast auszulegen.
8-5 Sony haftet nicht für die Nichterfüllung einer ihrer Verpflichtungen, wenn die Nichterfüllung auf Umstände zurückzuführen ist, die außerhalb ihrer Kontrolle liegen (höhere Gewalt). Während höherer Gewalt ruht die Verpflichtung zur Erfüllung ihrer Verpflichtungen. Wird die Erfüllung der vertraglichen Verpflichtungen durch höhere Gewalt für einen Zeitraum von mehr als dreißig Tagen unmöglich gemacht, ist jede Partei berechtigt, ohne gerichtliche Intervention und ohne jegliche Verpflichtung zum Ersatz des Schadens des Kunden vom Vertrag zurückzutreten.
8-6 Für den Verlust von Daten haftet Sony nur bis zur Höhe des Betrages, der bei ordnungsgemäßer und regelmäßiger Sicherung der Daten zur Wiederherstellung angefallen wäre.
9. Abtretung
9-1 Der Kunde ist nicht berechtigt, den Status oder die Rechte und Pflichten aus diesen Bedingungen ganz oder teilweise an einen Dritten abzutreten, eine Nachfolge zu veranlassen oder einem Dritten zum Zwecke der Sicherung zur Verfügung zu stellen.
9-2 Der Kunde erklärt sich damit einverstanden, dass Sony den Status oder die Rechte und Pflichten im Rahmen dieser Bedingungen sowie alle Informationen über den Kunden im Zusammenhang mit der Übertragung oder der Nachfolge des Geschäfts in Bezug auf die Leistungen auf einen Dritten übertragen oder ihre Nachfolge veranlassen kann.
10. Änderungen dieser Bedingungen
Sony ist berechtigt, diese Bedingungen jederzeit zu ändern, soweit und solange dies gesetzlich zulässig ist. Änderungen dieser Bedingungen werden dem Kunden schriftlich oder per E-Mail mitgeteilt. Widerspricht der Kunde solchen Änderungen nicht innerhalb von sechs Wochen nach Erhalt der Mitteilung, so gelten die Änderungen als vereinbart. Auf das Widerspruchsrecht und die Rechtsfolgen des Schweigens wird der Kunde im Falle der Änderung der Bedingungen gesondert hingewiesen.
11. Kontakt für Anfragen
Wenn der Kunde Fragen zu diesen Bedingungen hat, sollte er sich unter Verwendung des Kontaktformulars auf der Website der Leistung an uns wenden. Sony kann die Identität des Kunden auf die von Sony vorgeschriebene Weise bestätigen. Sofern nicht anderweitig gesetzlich vorgeschrieben, kann Sony jedes von Sony als geeignet erachtete Verfahren verwenden, um auf Anfragen des Kunden zu antworten oder diese anderweitig zu bearbeiten.
12. Geltendes Recht und Gerichtsstand
Diese Bedingungen unterliegen den Gesetzen Japans und sind in Übereinstimmung mit diesen auszulegen. Für Streitigkeiten und Meinungsverschiedenheiten, die sich aus der Leistung ergeben oder mit ihm in Zusammenhang stehen, ist in erster Instanz das Bezirksgericht Tokio in Tokio, Japan, als ausschließliches Gericht zuständig. Bei Verbrauchern ist das an ihrem Wohnsitz zuständige Gericht zuständig.
13. Verfahren zur Beilegung von Verbraucherstreitigkeiten
Die Plattform der EU-Kommission zur Online-Streitbeilegung ist im Internet unter www.ec.europa.eu/consumers/odr abrufbar. Sony weist den Kunden darauf hin, dass Sony nicht verpflichtet ist und sich nicht bereit erklärt, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen. Vielmehr ist Sony jederzeit bereit, etwaige Konflikte mit seinen Kunden direkt zu lösen. Bitte wenden Sie sich zu diesem Zweck an denKundensupport.
14. Sonstige Bedingungen
14-1 Jegliche Information, Mitteilung oder Kommunikation von Sony an den Kunden bezüglich der Leistung erfolgt durch Veröffentlichung auf der Website der Leistung oder auf jede andere Art und Weise, die Sony für angemessen hält.
14-2 Ist ein Teil dieser Bedingungen ungültig, nichtig oder aus irgendeinem Grund nicht durchsetzbar, so gilt dieser Teil als abtrennbar und berührt nicht die Gültigkeit und Durchsetzbarkeit der übrigen Teile.
14-3 Der ursprüngliche Rechteinhaber wird als Drittbegünstigter dieser Bedingungen behandelt und kann die entsprechenden Rechte direkt ausüben oder den Haftungsverzicht gemäß diesen Bedingungen geltend machen.
14-4 Zusätzlich zur englischen Version können diese Bedingungen in die Sprache des Servicebereichs übersetzt werden. Bei Widersprüchen in der Bedeutung oder im Wortlaut zwischen der englischen Version und der übersetzten Version ist die englische Version maßgebend.

These Terms of Service for “ Sword Art Online -EX-CHRONICLE- Online Edition” (these “Terms”) set forth the terms and conditions of use of the service “Sword Art Online -EX-CHRONICLE- Online Edition” (the “Service”) provided by Sony Music Solutions Inc. (“Sony”) for customers in the Service area (the “Customer”).
Sony may set separate terms and conditions related to the Service (including terms of use to be additionally applied to parts of the Service, operational rules to be separately notified within the Service) (the “Individual Terms”; which shall be deemed to constitute a part of these Terms except when otherwise specifically referred to), and the Customer shall also use the Service in accordance with the Individual Terms. If there is any discrepancy between these Terms and the Individual Terms or the contents of other websites, these Terms shall prevail unless otherwise specified.
Users of the Service must have reached the age of majority according to the respective legal system.
1. Service
1-1 Related data and documents, etc. and their updated/upgraded versions also constitute part of the Service.
1-2 Sony may place advertisements for Sony and third parties anywhere on the Service.
1-3 An Internet environment is required to use the Service. The Customer shall be responsible for setting up and maintenance of such Internet environment at such Customer’s own expense, including bearing the burden of communication charges and ensuring network security.
1-4 The Service is not intended to be used for the purpose of backup or storage of any data. Sony shall not be liable in any way for loss, alteration or the like of data contained in the Services, or inability to access, use, upload or download data contained in the Services except where tickets, etc. purchased by Customers are lost or otherwise become unable to be used due to reasons attributable to Sony, nor shall Sony be liable in the event of deletion of a user account, or for alteration, interruption or termination of the Services.
1-5 Parts of the Service may be provided for a fee, and P prices and payment terms will be announced on the website for the Service. Except as required by law, fees paid for the Service will not be refunded.
2. User Account
2-1 To use the Service, the Customer shall properly provide Sony with the required information and create a user account (the “Account”). The Customer may also create an Account by using a user account for other services (including third party services) designated by Sony. If Sony believes that any of the following applies or the provision of the Service is otherwise impossible or inappropriate, Sony may refuse to create an Account, delete the Account already created or take any other measures that Sony deems appropriate.
(1) If the Customer is a minor in the Service area.
(2) If the Customer provides Sony with information inconsistent with the facts, such as by using another person’s name or making a false statement.
(3) If the Customer has violated these Terms or any applicable laws and regulations during the use of the Service or in the past.
(4) If the Customer falls under the category of an organized crime group, a member of an organized crime group, those who were a member of an organized crime group in the past five years, an associate member of an organized crime group, a racketeer, a group engaging in criminal activities under the pretext of conducting social campaigns, a crime group specialized in intellectual crimes, etc., any other person equivalent to these, a person designated by the Japanese government or a foreign government as subject to economic sanctions, or a resident of a country or region designated by the Japanese government or foreign governments as subject to economic sanctions (collectively “Anti-Social Forces”), or a juridical person which has Anti-Social Forces involved in the management thereof.
(5) If the Customer has already created an Account.
2-2 If any information provided by the Customer to Sony in connection with the use of the Service is changed, the Customer shall carry out the change procedure without delay in the manner prescribed by Sony.
2-3 The Customer shall not use another Customer’s Account to use the Service and shall not allow any third party to use such Customer’s Account.
2-4 The Customer shall properly manage the information related to such Customer’s own Account, including the ID and password. The Customer shall be responsible for all acts and results of using the Service with such Customer’s own Account.
2-5 The Customer may withdraw from the Service (delete such Customer’s Account) at any time through the procedures prescribed by Sony. Upon withdrawal, the Customer shall lose all rights under these Terms; however, these Terms shall continue to apply even after such withdrawal to the matters related to the use of the Service by the Customer prior to the withdrawal.
3. Privacy
The Customer’s information acquired by Sony in connection with the Service shall be treated in accordance with Sony’s D Privacy Policy.
4. Prohibited Matters
4-1 In using the Service, the Customer shall not attempt or conduct any of the following acts and shall not cooperate with or promote any of such acts by any third party.
(1) Infringing the rights or legally protected interests (including intellectual property rights, trade secrets, honors, privacy rights, portrait rights, publicity rights and proprietary rights) of Sony or third parties;
(2) Violating laws, regulations, court decisions or other legally binding dispositions by a public authority, or offending public order and morals;
(3) Insulting, defaming, slandering Sony or any third party, or in the public domain of the Service, or uploading or transmitting by other means any expression or other information that includes offensive or antisocial content (including expressions that are excessively violent, explicitly sexual or may lead to discrimination);
(4) Bullying, harassment or any other act of obstructing the smooth use of the Service by other Customers (including sending false information or spam or interfering with the communications of other Customers);
(5) Illegal collection or use, or disclosure or provision to a third party, of personal information, other privacy related information, or confidential information such as passwords, of others;
(6) Using the Service to conduct acts for profit (except where approved in advance in writing by Sony), to meet or socialize with strangers of the opposite sex, or to conduct acts for other purposes different from the intended purpose of the Service;
(7) Downloading, distributing, making available for public transmission, modifying, operating, reverse engineering, decompiling, disassembling, erasing, etc. of all or any part of the Service beyond the scope expressly authorized by Sony (including the case of disabling or avoiding functions such as content protection and access control, or intentionally misusing defects in the Service);
(8) Incorporating or executing viruses or other programs or files that interfere with the proper operation of, obstruct/control the operations of, or browse/acquire or damage the data from, information terminals, network devices, systems, etc. managed by Sony or third parties, into or in such information terminals, etc.;
(9) Impeding the normal and smooth operation of the Service by, for example, imposing an excessive burden on the server of the Service or by making an excessive request beyond the scope of the legitimate exercise of the rights under these Terms;
(10) Any other violation of these Terms; or
(11) Other comparable matters deemed inappropriate by Sony
4-2 If Sony determines that the Customer is in breach of these Terms, Sony may suspend or delete such Customer’s Account.
4-3 Unless required otherwise by law, Sony has no obligation to monitor the Customer’s online activities on the Service; provided, however, that, to the extent permitted by laws and regulations and for legitimate purposes such as ensuring compliance with the laws and these Terms, Sony may record online activities on the Service and browse and disclose the same.
5. Intellectual Property Rights
5-1 Intellectual property rights and other rights relating to the Service are owned or controlled by Sony or the original right holder who licensed Sony (the “Original Rights Holder”).
5-2 The Service may include software for which the Original Rights Holder has set different terms of use from these Terms. If Sony notifies such terms of use within the Service, the Customer shall use the Service in accordance with such terms of use as well.
5-3 The Customer hereby grants Sony the non-exclusive right (with the right to sublicense the same) to use any image, sound, text or other information posted or transmitted by the Customer in connection with the Service (the “Posted Content”) (such use includes reproduction, distribution, public transmission, partial omission and other adaptations), in the entire Service area, without charge, by Sony or any party designated by Sony, to the extent permitted by applicable laws. The Customer also agrees to waive or not exercise any moral rights of the author regarding the Posted Content. It is the Customer’s responsibility to confirm that the Posted Content does not infringe upon the rights of third parties and otherwise conforms to the contents of these Terms.
5-4 Sony may take any action, including deletion from the Service, regarding any Posted Content that Sony deems to be in violation of these Terms or to be inappropriate, without any notice to the Customer. Sony shall not be liable to the Customer for such action.
6. Change, Suspension, Termination of the Service
6-1 Sony may, at its discretion, modify the Service, in whole or in part if the fulfilment of the Service is not or not significantly impaired by such modification. In connection with such modifications, it may be necessary for the Customer to update the Service, including the software therefor, as a condition to continue using the Service.
6-2 Sony may suspend the provision of the Service in whole or in part for the necessary period of time if any of the following applies:
(1) W When there is an interruption in the provision of third-party services (including, without limitation, telecommunications services and cloud services) that are necessary to provide the Service;
(2) When it is necessary to suspend the Service in order to perform maintenance and/or inspection of the system necessary for provision of the Service or to deal with its failure, defect, etc.;
(3) If the Service cannot be provided due to a power outage, natural disaster, labor dispute or other force majeure event; or
(4) When Sony deems it unavoidable.
6-3 Except in the case of emergency, Sony will notify the Customer prior to any change, suspension or termination of all or any part of the Service if such change, suspension or termination would have a significant impact on the Customer.
7. Disclaimer
7-1 Except to the extent prohibited by applicable laws, Sony makes no representation or warranty, either express or implied, with respect to the accuracy, safety and any other matters of the contents of third-party websites and services that may be accessed via a link from the Service, including advertisements on the Service. Sony shall not be liable for any damages or other consequences arising from the Customer’s use of such websites or services.
7-2 If any dispute arises between the Customer and a third party due to infringement of rights or for any other reason in connection with the Customer’s use of the Service, the Customer shall resolve such dispute at his/her own expense and responsibility, and Sony shall not be held liable in any way.
7-3 The Service is provided by Sony to the Customer under the contract between Sony and the Customer based on these Terms, and the Original Rights Holder shall not be held liable in any way to the Customer regarding the Service, unless otherwise provided by law.
8. Limitation of Liability
a)  wilful misconduct;
b)  death or personal injury;
c)  failure to fulfil an expressly assumed guaranty;
d)  if in other cases legal provisions provide for liability regardless of negligence or fault;
e)   gross negligence; and/or
f)  in case of a breach of a Material Duty;
Apart from that, Sony´s liability is excluded. A "Material Duty" within the meaning of the present agreement shall be (i) any contractual duty protecting an essential contractual position, the granting of which position is an essential aim and purpose of the agreement, and/or (ii) any contractual duty the fulfilment of which is a basic requirement enabling the proper performance of the Service in the first place and in the fulfilment of which the Contractor may usually trust.
8-2  In the case of section 8.1 d) to f), Sony shall only be liable for the typical and foreseeable damage.
8-3  The exclusions or limitations of liability shall also apply to the same degree in relation to any acts of Sony´s legal representatives, executive and non-executive employees and other vicarious agents as well as subcontractors. Sony does not assume any liability for employees or other auxiliary persons who are engaged in the performance of the contractual duties by the Customer and the Customer shall indemnify Sony against all expenses and claims by any third party for damages of such persons. This shall not apply in case these persons are deemed to be auxiliary persons of Sony.
8-4  The aforementioned provisions shall not be interpreted as a shift of the burden of proof.
8-5 Sony shall not be liable for failure to fulfil any of its obligations in case the failure is caused by circumstances beyond its control (force majeure). During force majeure the obligation to fulfil its obligations shall be suspended. In the event that the performance of the contractual obligations is made impossible by force majeure for a period longer than thirty days, each party shall be entitled to withdraw from the agreement without judicial intervention and without any obligation whatsoever to compensate the damages of the Customer.
8-6 For the loss of data Sony shall only be liable up to the amount that would have been incurred if the data had been properly and regularly backed up for recovery.
9. Assignment
9-1 The Customer may not assign, cause to be succeeded, or provide for the purpose of collateral to a third party, all or part of the status or rights and obligations under these Terms.
9-2 The Customer agrees that Sony may transfer or cause the succession of the status or rights and obligations under these Terms and any information about the Customers to a third party in connection with the transfer or succession of the business relating to the Services to such third party.
10. Changes to These Terms
Sony may change these Terms at any time to the extent permitted by law. The Customer will be notified of changes to these Terms in writing or by e-mail. If the Customer does not object to such changes within six weeks after receipt of the notification, the changes are deemed to be agreed. The Customer will be informed separately of the right to object and the legal consequences of silence in the event of the change of the Terms.

If the Customer has any questions about these Terms, he/she should contact us by using the contact form on the website of the Service. Sony may confirm the identity of the Customer by the method prescribed by Sony. Unless otherwise required by law, Sony may use any method deemed appropriate by Sony to respond to or otherwise cope with Customer inquiries.
12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Japan. Controversies and disputes arising out of or relating to the Service shall be submitted to the Tokyo District Court in Tokyo, Japan as the court of exclusive jurisdiction in the first instance. Consumers shall be sued in the court of their residence.
13. Consumer Dispute Settlement Proceedings
The EU-Commission’s platform for the online-settlement of disputes can be accessed online under www.ec.europa.eu/consumers/odr. Sony hereby informs the Customer that Sony is not obliged and does not agree to participate in settlement proceedings before any consumer arbitration boards. Rather, Sony is always ready to solve any conflicts with its customers directly. For this purpose, please contact customer support.
14. Miscellaneous
14-1 Any information, notice or communication from Sony to Customers regarding the Service shall be made by posting on the website of the Service or any other method as Sony deems appropriate.
14-2 If any portion of these Terms is deemed invalid, void or for any reason unenforceable, such portion shall be deemed severable and shall not affect the validity and enforceability of any remaining portion.
14-3 The Original Right Holder shall be treated as the third-party beneficiary of these Terms and may directly exercise the relevant rights or invoke the waiver of liability under these Terms.
14-4 In addition to the English version, these Terms may be translated into the language of the Service area. If there is any inconsistency in the meaning or wording between the English version and the translated version, the English version shall prevail.

These Terms of Service (these “Terms”) set forth the terms and conditions of use of the service “Sword Art Online -EX-CHRONICLE- Online Edition” (the “Service”) provided by Sony Music Solutions Inc. (“Sony”) for customers in the Service area (the “Customer”).
Sony may set separate terms and conditions related to the Service (including terms of use to be additionally applied to parts of the Service, operational rules to be separately notified within the Service) (the “Individual Terms”; which shall be deemed to constitute a part of these Terms except when otherwise specifically referred to), and the Customer shall also use the Service in accordance with the Individual Terms. If there is any discrepancy between these Terms and the Individual Terms or the contents of other websites, these Terms shall prevail unless otherwise specified.
If the Customer is a minor in the country or region that the Service is used, such Customer must obtain consent to these Terms from his/her parent or guardian or have the required parent or guardian consent to these Terms on his/her behalf, in accordance with the laws of such country or region, before using the Service.

(3) If the Customer has violated these Terms or any applicable laws and regulations during the use of the Service or in the past.

(8) Incorporating or executing viruses or other programs or files that interfere with the proper operation of, obstruct/control the operations of, or browse/acquire or damage the data from, information terminals, network devices, systems, etc. managed by Sony or third parties, into or in such information terminals, etc.;
(9) Impeding the normal and smooth operation of the Service by, for example, imposing an excessive burden on the server of the Service or by making an excessive request beyond the scope of the legitimate exercise of the rights under these Terms;
(10) Any other violation of these Terms; or
(11) Other comparable matters deemed inappropriate by Sony.
4-2 If Sony determines that the Customer is in breach of these Terms, Sony may suspend or delete such Customer’s Account or take any other action and shall have no responsibility whatsoever for such action.
4-3 Unless required otherwise by law, Sony has no obligation to monitor the Customer’s online activities on the Service; provided, however, that, to the extent permitted by laws and regulations and for legitimate purposes such as ensuring compliance with the laws and these Terms, Sony may record online activities on the Service and browse and disclose the same.
5. Intellectual Property Rights
5-1 Intellectual property rights and other rights relating to the Service are owned or controlled by Sony or the original right holder who licensed Sony (the “Original Rights Holder”).
5-2 The Service may include software for which the Original Rights Holder has set different terms of use from these Terms. If Sony notifies such terms of use within the Service, the Customer shall use the Service in accordance with such terms of use as well.
5-3 The Customer hereby grants Sony the non-exclusive right (with the right to sublicense the same) to use any image, sound, text or other information posted or transmitted by the Customer in connection with the Service (the “Posted Content”) (such use includes reproduction, distribution, public transmission, partial omission and other adaptations), in the entire Service area, without charge, by Sony or any party designated by Sony, to the extent permitted by applicable laws. The Customer also agrees to waive or not to exercise any moral rights of the author regarding the Posted Content. It is the Customer’s responsibility to confirm that the Posted Content does not infringe upon the rights of third parties and otherwise conforms to the contents of these Terms.
5-4 Sony may take any action, including deletion from the Service, regarding any Posted Content that Sony deems to be in violation of these Terms or to be inappropriate, without any notice to the Customer. Sony shall not be liable to the Customer for such action.
6. Change, Suspension, Termination of the Service
6-1 Sony may, at its discretion, modify or terminate the Service, in whole or in part. In connection with such modifications, it may be necessary for the Customer to update the Service, including the software therefor, as a condition to continue using the Service.
6-2 Sony may suspend the provision of the Service in whole or in part for the necessary period of time if any of the following applies:
(1)When there is an interruption in the provision of third-party services (including, without limitation, telecommunications services and cloud services) that are necessary to provide the Service;
(2) When it is necessary to suspend the Service in order to perform maintenance and/or inspection of the system necessary for provision of the Service or to deal with its failure, defect, etc.;
(3) If the Service cannot be provided due to a power outage, natural disaster, labor dispute or other force majeure event; or
(4) When Sony deems it unavoidable.

Sony shall not be liable for any damages or other consequences arising from the Customer’s use of such websites or services.
7-2 If any dispute arises between the Customer and a third party due to infringement of rights or for any other reason in connection with the Customer’s use of the Service, the Customer shall resolve such dispute at his/her own expense and responsibility, and Sony shall not be held liable in any way.
7-3 Except to the extent prohibited by applicable laws, Sony makes no representations and warranties, either express or implied, with respect to the quality or any other aspects of the Service (including defects such as bugs, security defects and infringement of the rights of third parties).
7-4 Notwithstanding any other provision of these Terms, and to the extent permitted by applicable laws, in the event of any damages suffered by the Customer due to Sony’s default or tort, Sony shall be liable for such damages only to the extent of the damage normally incurred by the Customer and up to the total amount of usage fees Sony received from the Customer, and shall not be liable for any consequential damages, indirect damages or other damages arising from special circumstances (including cases that are foreseen or foreseeable). However, Sony will not be exempted from liability for damages of the Customer due to Sony’s default or tort resulting from its willful misconduct or gross negligence.
7-5 The Service is provided by Sony to the Customer under the contract between Sony and the Customer based on these Terms, and the Original Rights Holder shall not be held liable in any way to the Customer regarding the Service, unless otherwise provided by law.
8. Assignment
8-1 The Customer may not assign, cause to be succeeded, or provide for the purpose of collateral to a third party, all or part of the status or rights and obligations under these Terms.
8-2 The Customer agrees that Sony may transfer or cause the succession of the status or rights and obligations under these Terms and any information about the Customers to a third party in connection with the transfer or succession of the business relating to the Services to such third party.
9. Changes to These Terms
Sony may change these Terms at any time to the extent permitted by law. Sony will notify Customers of the revised Terms through the website of the Service with a prior notice period that Sony deems reasonable considering the changes, etc.; provided, however, that such prior notice period may not be set if the changes are in accordance with the general interest of the Customers.
10. Contact for Inquiries
If the Customer has any questions about these Terms, he/she should contact us by using the contact form on the website of the Service. Sony may confirm the identity of the Customer by the method prescribed by Sony. Unless otherwise required by law, Sony may use any method deemed appropriate by Sony to respond to or otherwise cope with Customer inquiries.
11. Governing Law, Jurisdiction, Class or Representative Action Waiver, and Jury Waiver
11-1 These Terms (including any relevant non-contractual obligations) shall be governed by and construed in accordance with the laws of Japan. All controversies and disputes arising out of or relating to the Service (including any relevant non-contractual obligations) shall be submitted to the Tokyo District Court in Tokyo, Japan as the court of exclusive jurisdiction in the first instance.
11-2 By agreeing to these Terms, Customer agrees that Customer is required to resolve any claim that Customer may have against Sony related to the Service or these Terms on an individual basis. Customer agrees to waive any right Customer may otherwise have to bring any class, collective or representative action, and is precluded from participating in or recovering relief under any current or future class, collective, consolidated or representative action against Sony by someone else. Sony and Customer also agree to waive any right to a trial by jury.
12. Miscellaneous
12-1 Any information, notice or communication from Sony to Customers regarding the Service shall be made by posting on the website of the Service or any other method as Sony deems appropriate. If the Customer provides an email address, Customer shall be deemed to have consented to receiving information, notices and communications at that email address, and such electronic delivery will satisfy any legal communication requirements, including that such communications be in writing. Sony shall not be liable for any damages or other consequences of non-delivery or delay of such information, notice or communication, except where such damages or consequences are attributable to Sony.
12-2 If any portion of these Terms is deemed invalid, void or for any reason unenforceable, such portion shall be deemed severable and shall not affect the validity and enforceability of any remaining portion.
12-3 The Original Rights Holder shall be treated as the third-party beneficiary of these Terms and may directly exercise the relevant rights or invoke the waiver of liability under these Terms.

利用規約


この利用規約(以下「本規約」といいます)は、株式会社ソニー・ミュージックソリューションズ(以下「当社」といいます)が運営する「ソードアート・オンライン –エクスクロニクル– Online Edition」(以下「本サービス」といいます)の利用条件を定めるものであり、日本国内で本サービスを利用されるお客様(本サービスの利用希望者を含み、以下「お客様」といいます)に適用されます。
当社が本サービスに関連して別途個別の規約等(一部の本サービスに追加的に適用される利用条件、本サービス内において通知される運用ルール等を含み、以下「個別規約等」といいます。以下、個別に言及される場合を除き、個別規約等は本規約に含まれるものとします。)を定めた場合、お客様は個別規約等にも従って本サービスを利用されるものとします。個別規約等やその他ウェブサイト等の記載と、本規約の内容が異なる場合には、特段の定めがない限り本規約が優先するものとします。
お客様(きゃくさま)が未成年者(みせいねんしゃ)の場合(ばあい)、保護者(ほごしゃ)の方(かた)からこの利用規約(りようきやく)について同意(どうい)を得(え)てから本(ほん)サービスをご利用(りよう)ください。
1.本サービスについて
1-1 本サービスに関連するデータやドキュメント等およびそれらのアップデート・アップグレード版は、本サービスの一部を構成します。
1-2 当社は、本サービス上の任意の場所に、当社および第三者の広告を掲載することができるものとします。
1-3 本サービスのご利用にあたっては、インターネット環境が必要となります。インターネット環境の整備、通信料の負担、セキュリティの確保等は、お客様の費用と責任において行うものとします。
1-4 本サービスは、いかなるデータのバックアップや保管の目的に利用されることも想定されていません。当社は、本サービス内のデータに消失または変更等が生じたこと、本サービス内のデータへのアクセス・利用やアップロード・ダウンロードができないことについて、当社のみの責めに帰すべき事由によりお客様が購入されたチケット等が消失等した場合を除き一切責任を負わないものとし、ユーザーアカウントの削除や本サービスの変更、中断または終了の際においても同様とします。
1-5 本サービスの一部は有料で提供される場合があり、その価格や支払条件等は本サービスのウェブサイト等においてご案内いたします。法令により要請される場合を除き、本サービスに関して支払われた代金の払い戻しはいたしません。
2.ユーザーアカウント
2-1 本サービス内の有料サービスをご利用されるお客様は、当社所定の必要情報を正しく当社に提供し、本サービスを利用するためのユーザーアカウント(以下「アカウント」といいます)を作成するものとします。ただし、当社は、次のいずれかに該当すると疑われる場合その他本サービスの提供が不可能または不適切と判断する場合には、アカウントの作成を拒否することができるものとし、また、アカウントの作成後においてもアカウントの削除等の措置をとることができるものとします。
(1) お客様が未成年者であり、かつ、本サービスの利用について法定代理人の同意を得ていない場合
(2) 他人名義の利用や虚偽記載など、お客様が事実と異なる情報を当社に提供した場合
(3) お客様が過去に本規約に反する行為を行った者である場合
(4) お客様が、暴力団、暴力団員、暴力団員でなくなった日から5年を経過しない者、暴力団準構成員、総会屋、社会運動等標榜ゴロ、特殊知能暴力集団その他これらに準じる者、日本政府もしくは外国政府が経済制裁の対象として指定する者、日本政府もしくは外国政府が経済制裁の対象として指定する国ないし地域の居住者(以下総称して「反社会的勢力等」といいます)に該当し、あるいは、これら反社会的勢力等が経営に実質的に関与している法人等に該当する場合
(5) お客様が既にアカウントを作成済みである場合
2-2 本サービスの利用に際してお客様が当社に提供した情報に変更が生じた場合、お客様は遅滞なく当社所定の方法で変更手続を行うものとします。
2-3 お客様は、他のお客様のアカウントを使用して本サービスを利用してはならず、また、自己のアカウントを第三者に使用させてはならないものとします。
2-4 お客様は、ID、パスワード等を含む自己のアカウントに関する情報を適切に管理するものとします。お客様は、自己のアカウントにより本サービスを利用してなされた一切の行為およびその結果について、責任を負うものとします。
2-5 お客様は、当社所定の手続を経て、いつでも本サービスからの退会(ユーザーアカウントの削除)をすることができます。退会によりお客様は本規約上の一切の権利を失うものとします。ただし、退会前になされたお客様による本サービスの利用に関連する事項には、お客様の退会後もなお本規約が適用されるものとします。
3.プライバシー
本サービスに関連して当社が取得するお客様に関する情報の取扱いは、当社のプライバシーポリシーに従うものとします。
お客様は、アカウントの作成により、本サービスに関連するご案内やアンケートのメール受信に同意するものとします。なお、本サービスのマイページから設定を変更することによりいつでも配信を停止することができます。
4.禁止事項
4-1 お客様は、本サービスの利用にあたり、以下のような行為を自ら試みまたは行なってはならず、かつ、第三者による行為に協力しまたはこれを助長してはならないものとします。
(1) 当社または第三者の権利もしくは法律上保護される利益(知的財産権、営業秘密、名誉、プライバシー、肖像権、パブリシティ権、所有権を含みます)を侵害すること
(2) 法令、裁判所の判決その他公的機関による法的拘束力のある処分、または公序良俗に反すること
(3) 当社または第三者に対し、あるいは本サービスの公開された領域において、侮辱、名誉毀損、誹謗を行い、また、他人に不快感を与えるまたは反社会的な内容を含む表現(過度に暴力的な表現、露骨な性的表現、差別につながるおそれのある表現を含みます)等の情報をアップロードその他の手段で発信・伝達すること
(4) いじめ、嫌がらせ、その他本サービスの他のお客様による円滑な利用を妨害すること(虚偽の情報やスパムの送信、他のお客様のコミュニケーションの妨害を含みます)
(5) 他人の個人情報その他プライバシーにかかわる情報やパスワード等の秘匿情報を不正に収集・利用し、または公開もしくは第三者に提供すること
(6) 本サービスを利用して、営利を目的とする行為(事前に当社の承諾を得たものを除きます)、面識のない異性との出会いや交際を目的とする行為その他本サービスが予定する利用目的と異なる目的のための行為を行うこと
(7) 本サービスの全部または一部を当社によって明示的に許可された範囲を超えてダウンロード、複製、頒布、公衆送信可能化、改変ないし操作、リバースエンジニアリング、逆コンパイル、逆アセンブル、消去等すること(アプリケーションに搭載されている撮影機能によるものも含め、有料エリアでの撮影・録音・録画等を行う場合のほか、コンテンツ保護やアクセスコントロール等の機能を無効化または回避して行う場合や、本サービスの不具合を意図的に利用して行う場合を含みます)
(8) 当社または第三者が管理する情報端末、ネットワーク機器、システム等に、その適切な稼働を阻害したり、操作を妨害・制御したり、データを閲覧・取得ないし毀損するなどの動作をするウイルスその他のプログラムやファイル等を組み込みまたは実行させること
(9) 本サービスのサーバー等に過度の負担を与え、あるいは、本規約上の権利の正当な行使の範囲を超えた過度な要求をするなど、本サービスの正常かつ円滑な運営に支障を与えること
(10) その他本規約に違反すること
(11) その他上記に準ずる当社が不適切と判断すること
4-2 当社は、お客様が本規約に違反していると判断した場合、アカウントの停止、削除、本サービスの利用停止その他の措置をとることができるものとし、当該措置に関してお客様に一切責任を負わないものとします。
4-3 法令により要請されない限り、本サービス上のお客様のオンライン活動に関して、当社は監視する義務を負いません。ただし、当社は、法令や本規約の遵守の確保等の正当な目的のため、法令により認められた範囲内で、本サービス上のオンライン活動を記録し、また、これを閲覧、開示等することができるものとします。
5.知的財産権等
5-1 本サービスに関する知的財産権その他の権利は、当社または当社に利用を許諾した原権利者(以下「原権利者」といいます)に帰属します。本サービスの利用許諾は、本サービスに関する知的財産権その他の権利の利用許諾を意味するものではありません。
5-2 本サービスには、本規約とは異なる利用条件を原権利者が定めたソフトウェアが含まれている場合があります。当社が当該利用条件を本サービス内において通知した場合、お客様は当該利用条件にも従って本サービスを利用されるものとします。
5-3 お客様は、本サービスに関連して投稿または発信等した画像、音声、文章その他情報(以下、併せて「投稿コンテンツ」といいます)について、当社に対して、当社または当社の指定する者が日本国内外を問わず対価の支払いなく非独占的に自由に利用(複製、頒布、公衆送信、一部の省略その他の翻案を含みます)する権利(再許諾する権利を含みます)を許諾するものとし、また、当該投稿コンテンツに関する著作者人格権を行使しないものとします。また、お客様は、投稿コンテンツについて、他のお客様に対して、日本国内外を問わず対価の支払いなく非独占的に本サービス内で定める使用範囲において複製および公衆送信する権利を許諾するものとします。なお、投稿コンテンツが第三者の権利を侵害していないことその他本規約の内容に適合することは、お客様の責任においてこれを確認するものとします。
5-4 当社は、本規約に違反するまたは不適切であると当社が判断した投稿コンテンツについて、お客様に通知することなく、本サービス上からの削除等の措置をとることができるものとし、当該措置に関してお客様に一切責任を負わないものとします。
6.本サービスの変更・中断・終了
6-1 当社は、その裁量により、本サービスの全部または一部を変更または終了することができるものとします。なお、当該変更に関連し、本サービス等のアップデートを行うことが本サービスの利用を継続するための条件となる場合があります。
6-2 当社は、以下のいずれかに該当する場合、本サービスの全部または一部の提供を必要な期間中断することができるものとします。
(1) 本サービスの提供に必要な第三者のサービス(電気通信サービス、クラウドサービスを含みますがこれらに限定されません)の提供が中断した場合
(2) 本サービスの提供に必要なシステムの保守・点検を実施しまたはその故障・不具合等に対処するために本サービスの中断が必要な場合
(3) 停電、天変地変、労働争議その他不可抗力により本サービスの提供ができなくなった場合
(4) その他当社がやむを得ないと判断した場合
6-3 当社は、本サービスの全部または一部の変更・中断・終了に際し、それによりお客様に大きな影響を与える場合には、緊急やむを得ない場合を除きあらかじめお客様に通知をしたうえでこれを行うものとします。
6-4 当社は、本サービスの変更・中断・終了に関連してお客様に生じた損害その他の結果について、当社の責めに帰すべき事由による場合を除き一切責任を負わないものとします。
7. 免責事項
7-1 当社は、本サービス上の広告を含む本サービスからのリンクにより遷移可能な第三者のウェブサイトやサービスの内容等の正確性、安全性その他のいかなる事項についても明示または黙示を問わず何らの保証も行わないものとし、お客様による当該ウェブサイトやサービスの利用による損害その他の結果について一切責任を負わないものとします。
7-2 お客様は、お客様による本サービスの利用に関連して第三者との間で権利侵害その他の事由により紛争が生じた場合、お客様自らの費用と責任において解決するものとし、当社は一切責任を負わないものとします。
7-3 当社は、本サービスの品質その他のいかなる事項(バグ等の不具合やセキュリティ等に関する欠陥および第三者の権利侵害の有無を含みます)についても、明示または黙示を問わず何らの保証もいたしません。
7-4 本規約の他の規定にかかわらず、当社は、その債務不履行または不法行為によりお客様に損害が生じた場合、お客様に通常生じうる損害の範囲に限り、かつ、当社がお客様から受領した代金の総額を上限としてこれを賠償する責任を負うものとし、特別な事情から生じた損害等(損害発生を予見しまたは予見し得た場合を含みます)については一切責任を負わないものとします。但し、当社は、その故意または重大な過失による債務不履行または不法行為に起因してお客様に生じた損害に対する賠償責任については、免責されないものとします。
7-5 本サービスは、当社とお客様との間で本規約をその内容として成立する契約に基づき、当社からお客様に対して提供されるものであり、原権利者は、法令上別段の定めがない限り、本サービスに関してお客様に対し一切責任を負わないものとします。
8. 本規約上の地位の譲渡等
8-1 お客様は、本規約上の地位または権利義務の全部もしくは一部を、第三者に譲渡し、承継させ、または担保の目的に供することはできないものとします。
8-2 当社は、本サービスに関する事業を第三者に譲渡または承継させることに伴い、本規約上の地位および権利義務その他お客様に関する情報等を当該第三者に譲渡ないし承継させることができるものとし、お客様はあらかじめこれに同意するものとします。
9.本規約の変更
当社は、法令で認められた範囲において、本規約を随時変更することができるものとします。当社は、変更後の本規約の適用開始に先立ち、変更内容等に照らして当社が合理的と判断する事前告知期間を設定したうえで(ただし、本規約の変更内容が緊急やむを得ない場合またはお客様の一般の利益に適合するものである場合は事前告知期間を定めないことができるものとします)、変更後の本規約を本サービスのウェブサイトを通じてお客様に周知いたします。
10.お問い合わせ窓口
本規約についてのご質問等がある場合には、お問い合わせ窓口にご連絡ください。なお、当社は、当社所定の方法により、お客様の本人確認を行うことができるものとします。また、お問い合せに対する回答その他の対応は、法令の要請がない限り、当社が適切と判断する方法で行うことができるものとします。
11. 準拠法および裁判管轄
本規約の準拠法は、日本法とします。お客様と当社との間の本サービスに関連する一切の紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします。
12.その他
12-1 本サービスに関する当社からお客様へのご案内、通知または連絡は、本サービスのウェブサイトへの掲示その他当社が適当と判断する方法により行われるものとします。なお、当社は、ご案内等の不着や遅延等による損害その他の結果について、当社のみの責めに帰すべき事由による場合を除き一切責任を負わないものとします。
12-2 本規約の一部分が無効と判明した場合でも、本規約の残りの部分はその影響を受けず引続き有効に存続するものとします。
12-3 原権利者は本規約の第三受益者として取り扱われるものとし、関連する本規約上の権利を直接行使しあるいは免責等を援用することができるものとします。

이 이용규약(이하 "본 규약"이라고 합니다)은 주식회사 Sony Music Solutions Inc. (이하 "소니"라고 합니다)가 운영하는 서비스 “Sword Art Online -EX-CHRONICLE- Online Edition” (이하 "본 서비스"라고 합니다)의 이용조건을 정하는 것으로, 본 서비스 제공 지역에서 본 서비스를 이용하는 고객님(이하 "고객님"이라고 합니다)께 적용됩니다.
소니가 본 서비스와 관련하여 별도 개별의 규약 등(일부 본 서비스에 추가적으로 적용되는 이용조건, 본 서비스 내에서 통지되는 운용규칙 등을 포함하며 이하 "개별규약 등"이라고 합니다. 이하, 개별적으로 언급되는 경우를 제외하고 개별규약 등은 본 규약에 포함됩니다.)을 정한 경우, 고객님은 개별규약 등도 준수하여 본 서비스를 이용합니다. 개별규약 등이나 기타 웹사이트 등의 기재와 본 규약의 내용이 다른 경우 특별한 규정이 없는 한 본 규약이 우선합니다.
고객님께서 본 서비스를 이용하는 국가 또는 지역에서 미성년자인 경우, 그 국가 또는 지역의 법률에 따라, 보호자로부터 이 이용규약에 대한 동의를 얻은 후, 또는 필요한 보호자의 대리에 의해 이 이용규약에 대한 동의를 얻은 후에, 본 서비스를 이용하시기 바랍니다.
1. 본 서비스에 대하여
1-1 본 서비스와 관련하는 데이터나 문서 등 및 이것들의 업데이트·업그레이드 판은 본 서비스의 일부를 구성합니다.
1-2 소니는 본 서비스 상의 임의의 장소에 소니 및 제3자의 광고를 게재할 수 있습니다.
1-3 본 서비스의 이용에 있어서는 인터넷 환경이 필요합니다. 인터넷 환경의 정비, 통신료의 부담, 보안의 확보 등은 고객님의 비용과 책임으로 실시합니다.
1-4 본 서비스는 어떠한 데이터의 백업이나 보관 목적으로 이용되는 것을 상정하고 있지 않습니다. 소니는 본 서비스 내의 데이터에 소실 또는 변경 등이 발생한 경우, 본 서비스 내의 데이터에 대한 액세스·이용이나 업로드·다운로드가 불가능한 경우에 대하여, 소니의 귀책사유로 인하여 고객님께서 구매한 티켓 등이 소실된 경우를 제외하고는 일절 책임을 지지 않으며, 사용자 계정의 삭제나 본 서비스의 변경, 중단 또는 종료 시에도 동일합니다.
1-5 본 서비스 중 일부는 유료로 제공될 수 있으며 그 가격이나 지불조건 등은 본 서비스의 웹사이트 등에서 안내합니다. 법령에 따라 요청되는 경우를 제외하고, 본 서비스와 관련하여 지불된 이용료는 환불을 해드리지 않습니다.
2. 사용자 계정
2-1 본 서비스의 이용 희망자는 소니 소정의 필요 정보를 정확하게 소니에게 제공하고, 본 서비스를 이용하기 위한 사용자 계정(이하 ”계정”라고 합니다)을 작성합니다. 또한, 고객님께서는 소니가 별도 지정하는 다른 서비스(제3자의 서비스를 포함합니다)의 사용자 계정을 이용함으로써 계정을 작성할 수 있습니다. 단, 소니는 다음 중 하나에 해당한다고 의심되는 경우, 기타 본 서비스의 제공이 불가능하거나 부적절하다고 판단하는 경우 계정 작성을 거부할 수 있으며, 또한 계정 작성 후에도 계정 삭제 등의 조치를 취할 수 있습니다.
(1) 이용 희망자가 본 서비스 제공 지역에서 미성년자이며 본 서비스 제공 지역에 관한 법률에 기초하여 요구되는 본 서비스 이용에 대한 법정대리인의 동의 또는 필요한 대리를 얻지 않은 경우
(2) 타인 명의의 이용이나 허위 기재 등 이용 희망자가 사실과 다른 정보를 소니에게 제공한 경우
(3)이용 희망자가 본 서비스의 이용 중 또는 그 과거에 본 규약 또는 적용되는 법령에 반하는 행위를 한 자인 경우
(4) 이용 희망자가 폭력단, 폭력단원, 폭력단원이 아니게 된 날로부터 5년이 경과하지 않은 자, 폭력단 준구성원, 총회꾼, 사회운동 등 표방자, 특수지능 폭력집단, 기타 이들에 준하는 자, 일본 정부 또는 외국 정부가 경제제재의 대상으로 지정하는 자, 일본 정부 또는 외국 정부가 경제제재의 대상으로 지정하는 국가 또는 지역의 거주자(이하 총칭하여 "반사회적 세력 등"이라고 합니다)에 해당하거나 반사회적 세력 등이 경영에 실질적으로 관여하고 있는 법인 등에 해당하는 경우
(5) 이용 희망자가 이미 계정을 작성했던 경우
2-2 본 서비스를 이용함에 있어서 고객님께서 소니에게 제공한 정보에 변경이 생긴 경우 고객님께서는 지체 없이 소니 소정의 방법으로 변경 절차를 밟아야 합니다.
2-3 고객님께서는 다른 고객님의 계정을 사용하여 본 서비스를 이용해서는 안 되며, 자신의 계정을 제3자에게 사용하게 해서는 안 됩니다.
2-4 고객님께서는 ID, 패스워드 등을 포함한 자신의 계정에 관한 정보를 적절히 관리하여야 합니다. 고객님께서는 자신의 계정에 의하여 본 서비스를 이용하여 이루어진 일체의 행위 및 그 결과에 대하여 책임을 집니다.
2-5 고객님께서는 소니 소정의 절차를 거치고, 언제라도 본 서비스에서의 탈퇴(사용자 계정 삭제)를 할 수 있습니다. 탈퇴로 인하여 고객님은 본 규약상의 일체의 권리를 상실합니다. 단, 탈퇴 전에 이루어진 고객님의 본 서비스의 이용에 관련한 사항에는 고객님의 탈퇴 후에도 본 규약이 적용됩니다.
3. 프라이버시
본 서비스와 관련하여 소니가 취득하는 고객님에 관한 정보의 취급은 소니의개인정보보호방침을 따릅니다.
4. 금지사항
4-1 고객님께서는 본 서비스를 이용함에 있어서 다음과 같은 행위를 스스로 시도하거나 행하여서는 안 되며, 또한 제3자에 의한 행위에 협력하거나 이를 조장하여서는 안 됩니다.
(1) 소니 또는 제3자의 권리 혹은 법률상 보호되는 이익(지적재산권, 영업비밀, 명예, 프라이버시, 초상권, 퍼블리시티권, 소유권을 포함합니다)을 침해하는 것
(2) 법령, 법원의 판결, 기타 공적 기관에 의한 법적 구속력이 있는 처분 또는 공서양속에 반하는 것
(3) 소니나 제3자에 대하여 또는 본 서비스의 공개된 영역에서, 모욕, 명예훼손, 비방을 하거나 타인에게 불쾌감을 주거나 반사회적인 내용을 포함하는 표현(과도하게 폭력적인 표현, 노골적인 성적 표현, 차별로 이어질 우려가 있는 표현을 포함합니다) 등의 정보를 업로드 기타 수단으로 발신, 전달하는 것
(4)왕따, 괴롭힘, 기타 다른 고객님에 의한 본 서비스의 원활한 이용을 방해하는 것(허위 정보나 스팸 발송, 다른 고객님의 커뮤니케이션 방해를 포함합니다)
(5) 타인의 개인정보, 기타 프라이버시와 관련된 정보나 패스워드 등 은닉된 정보를 부정하게 수집·이용하거나 공개 또는 제3자에게 제공하는 것
(6) 본 서비스를 이용하여 영리를 목적으로 하는 행위(사전에 소니의 서면 승낙을 받은 것은 제외합니다), 안면이 없는 이성과의 만남이나 교제를 목적으로 하는 행위, 기타 본 서비스가 예정하는 이용 목적과 다른 목적을 위한 행위를 하는 것
(7) 본 서비스의 전부 또는 일부를 소니에 의해 명시적으로 허가된 범위를 넘어 다운로드, 배포, 공중송신 가능화, 개변 혹은 조작, 리버스 엔지니어링, 역컴파일, 역어셈블, 소거 등을 하는 것(콘텐츠 보호나 액세스 컨트롤 등의 기능을 무효화하거나 회피하여 행하는 경우나 본 서비스의 오류를 의도적으로 이용하여 행하는 경우를 포함합니다)
(8)소니 또는 제3자가 관리하는 정보단말기, 네트워크 기기, 시스템 등에 적절한 가동을 저해하거나 조작을 방해·제어하거나 데이터를 열람·취득 내지 훼손하는 등의 동작을 하는 바이러스 및 기타 프로그램이나 파일 등을 설치하거나 실행시키는 것
(9) 본 서비스의 서버 등에 과도한 부담을 주거나 본 규약상의 권리의 정당한 행사 범위를 넘어선 과도한 요구를 하는 등 본 서비스의 정상적이고 원활한 운영에 지장을 주는 것
(10) 기타 본 규약을 위반하는 것
(11) 기타 소니가 부적절하다고 판단하는 것,
4-2 소니는 고객님께서 본 규약을 위반했다고 판단한 경우, 계정의 정지나 삭제, 기타 조치를 취할 수 있으며, 해당 조치에 대하여 고객님에 대하여 일절 책임을 지지 않습니다.
4-3 법령에 따라 요청되지 않는 한, 소니는 본 서비스상의 고객님의 온라인 활동에 관하여 감시할 의무를 지지 않습니다. 단, 소니는 법령이나 본 규약의 준수 확보 등의 정당한 목적을 위하여 법령에 따라 인정된 범위 내에서 본 서비스상의 온라인 활동을 기록하거나 이를 열람, 공개 등을 할 수 있습니다.
5. 지적재산권 등
5-1 본 서비스에 관한 지적재산권 기타 권리는 소니 또는 소니에게 이용을 허락한 원 권리자(이하 "원 권리자"라고 합니다)에게 귀속됩니다.
5-2 본 서비스에는 본 규약과 다른 이용조건을 원 권리자가 정한 소프트웨어가 포함되어 있는 경우가 있습니다. 소니가 해당 이용조건을 본 서비스 내에서 통지한 경우, 고객님께서는 해당 이용조건에 따라 본 서비스를 이용하여야 합니다.
5-3 고객님께서는 적용되는 법률에서 허용되는 범위에서, 본 서비스와 관련하여 투고 또는 발신 등을 한 화상, 음성, 문장 기타 정보(이하, 총칭하여 "투고 콘텐츠"라고 합니다)에 관하여 소니에 대해서 소니 또는 소니가 지정하는 자가 모든 본 서비스 제공 지역에서 대가의 지불 없이 비독점적으로 자유롭게 이용(복제, 배포, 공중송신, 일부의 생략 그 외의 번안을 포함합니다)하는 권리(재허락하는 권리를 포함합니다)를 허락하고, 또 해당 투고 콘텐츠에 관한 저작인격권을 포기하거나 행사하지 않습니다. 또한, 투고 콘텐츠가 제3자의 권리를 침해하지 않을 것 및 기타 본 규약의 내용에 적합할 것은, 고객님의 책임으로 이를 확인합니다.
5-4 소니는 본 규약에 위반되거나 부적절하다고 소니가 판단한 투고 콘텐츠에 대해, 고객님께 통지하지 않고 본 서비스상에서 삭제 등의 조치를 취할 수 있으며, 해당 조치에 관하여 고객님에 대하여 일절 책임을 지지 않습니다.
6. 본 서비스의 변경·중단·종료
6-1 소니는 그 재량에 따라 본 서비스의 전부 또는 일부를 변경 또는 종료할 수 있습니다. 또한 해당 변경과 관련하여 본 서비스 등을 업데이트하는 것이 본 서비스 이용을 계속하기 위한 조건이 되는 경우가 있습니다.
6-2 소니는 다음 중 하나에 해당하는 경우, 본 서비스의 전부 또는 일부의 제공을 필요한 기간 동안 중단할 수 있습니다.
(1)본 서비스의 제공에 필요한 제3자의 서비스(전기통신 서비스, 클라우드 서비스를 포함하지만 이에 한정되지 않습니다)의 제공이 중단된 경우
(2) 본 서비스의 제공에 필요한 시스템의 보수·점검을 실시하거나 그 고장·결함 등에 대처하기 위해 본 서비스의 중단이 필요한 경우
(3) 정전, 천재지변, 노동쟁의, 기타 불가항력으로 인하여 서비스를 제공할 수 없게 된 경우
(4) 기타 소니가 부득이하다고 판단했을 경우
6-3 소니는 본 서비스의 전부 또는 일부의 변경·중단·종료 시에, 그로 인하여 고객님께 큰 영향을 주는 경우에는, 긴급하고 부득이한 경우를 제외하고 미리 고객님께 통지를 한 후에 이것을 실시합니다.
6-4 소니는 본 서비스의 변경·중단·종료와 관련하여 고객님께 발생한 손해 기타 결과에 대해 소니의 귀책사유로 인한 경우를 제외하고는 일절 책임을 지지 않습니다.
7. 면책사항
7-1 소니는 본 서비스상의 광고를 포함한 본 서비스의 링크에 의해 이동 가능한 제3자의 웹사이트나 서비스 내용 등의 정확성, 안전성, 기타 어떠한 사항에 대해서도 명시 또는 묵시를 불문하고 아무런 보증도 하지 않으며, 고객님에 의한 해당 웹사이트나 서비스 이용으로 인한 손해 기타 결과에 대해 일절 책임을 지지 않습니다.
7-2 고객님께서는 고객님에 의한 본 서비스 이용과 관련하여 제3자와의 사이에 권리 침해 기타 사유로 분쟁이 발생한 경우, 고객님 자신의 비용과 책임으로 해결하며, 소니는 일절 책임을 지지 않습니다.
7-3 소니는 본 서비스의 품질 기타 어떠한 사항(버그 등의 오류나 보안 등에 관한 결함 및 제3자의 권리 침해 여부를 포함합니다)에 대해서도 명시 또는 묵시를 불문하고 어떠한 보증도 하지 않습니다.
7-4 본 규약의 다른 규정에도 불구하고 소니는 적용되는 법률에서 허용되는 범위에서, 그 채무불이행 또는 불법행위로 인하여 고객님께 손해가 발생한 경우, 고객님께 통상적으로 발생할 수 있는 손해의 범위에 한하여, 소니가 고객님으로부터 수령한 이용료의 총액을 상한으로 하여 이를 배상할 책임을 지기로 하고, 결과손해, 간접적인 손해 기타 특별한 사정으로 인하여 발생한 손해 등(손해발생을 예견하거나 예견할 수 있었던 경우를 포함합니다)에 대하여는 일절 책임을 지지 않습니다. 단, 소니는 그 고의 또는 중대한 과실에 의한 채무불이행 또는 불법행위로 인하여 고객님께 발생한 손해에 대한 배상책임에 대해서는 면책되지 않습니다.
7-5 본 서비스는 소니와 고객님 사이에 본 규약을 그 내용으로 하여 성립하는 계약에 따라 소니로부터 고객님에 대하여 제공되는 것이며, 원 권리자는 법령상 별도의 규정이 없는 한 본 서비스에 관하여 고객님에 대하여 일절 책임을 지지 않습니다.
8. 본 규약상의 지위의 양도 등
8-1 고객님께서는 본 규약상의 지위 또는 권리의무의 전부 또는 일부를 제3자에게 양도 또는 승계하거나 담보의 목적으로 제공할 수 없습니다.
8-2 소니는 본 서비스에 관한 사업을 제3자에게 양도 또는 승계시킴에 따라 본 규약상의 지위 및 권리의무 기타 고객님에 관한 정보 등을 해당 제3자에게 양도 또는 승계시킬 수 있으며, 고객님께서는 사전에 이에 동의하는 것으로 합니다.

12. 기타
12-1 본 서비스에 관한 소니로부터의 고객님에 대한 안내, 통지 또는 연락은, 본 서비스의 웹 사이트 내 게시 상에서의 표시 기타 소니가 적당하다고 판단하는 방법에 의해 이루어집니다. 또한, 소니는 안내 등이 도착하지 않거나, 지연되는 등에 의한 손해 기타 결과에 대해서, 소니의 귀책사유로 인한 경우를 제외하고 일절 책임을 지지 않습니다.

Terms of Service


These Terms of Service (these “Terms”) set forth the terms and conditions of use of the service “Sword Art Online -EX-CHRONICLE- Online Edition” (the “Service”) provided by Sony Music Solutions Inc. (“Sony”) for customers in the Service area (the “Customer”).
Sony may set separate terms and conditions related to the Service (including terms of use to be additionally applied to parts of the Service, operational rules to be separately notified within the Service) (the “Individual Terms”; which shall be deemed to constitute a part of these Terms except when otherwise specifically referred to), and the Customer shall also use the Service in accordance with the Individual Terms. If there is any discrepancy between these Terms and the Individual Terms or the contents of other websites, these Terms shall prevail unless otherwise specified.
If the Customer is a minor in the country or region that the Service is used, such Customer must obtain consent to these Terms from his/her parent or guardian or have the required parent or guardian consent to these Terms on his/her behalf, in accordance with the laws of such country or region, before using the Service.
1. Service
1-1 Related data and documents, etc. and their updated/upgraded versions also constitute part of the Service.
1-2 Sony may place advertisements for Sony and third parties anywhere on the Service.
1-3 An Internet environment is required to use the Service. The Customer shall be responsible for setting up and maintenance of such Internet environment at such Customer’s own expense, including bearing the burden of communication charges and ensuring network security.
1-4 The Service is not intended to be used for the purpose of backup or storage of any data. Sony shall not be liable in any way for loss, alteration or the like of data contained in the Services, or inability to access, use, upload or download data contained in the Services except where tickets, etc. purchased by Customers are lost or otherwise become unable to be used due to reasons attributable to Sony, nor shall Sony be liable in the event of deletion of a user account, or for alteration, interruption or termination of the Services.
1-5 Parts of the Service may be provided for a fee, and prices and payment terms will be announced on the website for the Service. Except as required by law, fees paid for the Service will not be refunded.
2. User Account
2-1 To use the Service, the Customer shall properly provide Sony with the required information and create a user account (the “Account”). The Customer may also create an Account by using a user account for other services (including third party services) designated by Sony. If Sony believes that any of the following applies or the provision of the Service is otherwise impossible or inappropriate, Sony may refuse to create an Account, delete the Account already created or take any other measures that Sony deems appropriate.
(1) If the Customer is a minor in the Service area and has not obtained the consent of a statutory agent or required proxy to use the Service as required under the laws regarding the Service area.
(2) If the Customer provides Sony with information inconsistent with the facts, such as by using another person’s name or making a false statement.
(3) If the Customer has violated these Terms or any applicable laws and regulations during the use of the Service or in the past.
(4) If the Customer falls under the category of an organized crime group, a member of an organized crime group, those who were a member of an organized crime group in the past five years, an associate member of an organized crime group, a racketeer, a group engaging in criminal activities under the pretext of conducting social campaigns, a crime group specialized in intellectual crimes, etc., any other person equivalent to these, a person designated by the Japanese government or a foreign government as subject to economic sanctions, or a resident of a country or region designated by the Japanese government or foreign governments as subject to economic sanctions (collectively “Anti-Social Forces”), or a juridical person which has Anti-Social Forces involved in the management thereof.
(5) If the Customer has already created an Account.
2-2 If any information provided by the Customer to Sony in connection with the use of the Service is changed, the Customer shall carry out the change procedure without delay in the manner prescribed by Sony.
2-3 The Customer shall not use another Customer’s Account to use the Service and shall not allow any third party to use such Customer’s Account.
2-4 The Customer shall properly manage the information related to such Customer’s own Account, including the ID and password. The Customer shall be responsible for all acts and results of using the Service with such Customer’s own Account.
2-5 The Customer may withdraw from the Service (delete such Customer’s Account) at any time through the procedures prescribed by Sony. Upon withdrawal, the Customer shall lose all rights under these Terms; however, these Terms shall continue to apply even after such withdrawal to the matters related to the use of the Service by the Customer prior to the withdrawal.
3. Privacy
The Customer’s information acquired by Sony in connection with the Service shall be treated in accordance with Sony’s Privacy Policy.
4. Prohibited Matters
4-1 In using the Service, the Customer shall not attempt or conduct any of the following acts and shall not cooperate with or promote any of such acts by any third party.
(1) Infringing the rights or legally protected interests (including intellectual property rights, trade secrets, honors, privacy rights, portrait rights, publicity rights and proprietary rights) of Sony or third parties;
(2) Violating laws, regulations, court decisions or other legally binding dispositions by a public authority, or offending public order and morals;
(3) Insulting, defaming, slandering Sony or any third party, or in the public domain of the Service, or uploading or transmitting by other means any expression or other information that includes offensive or antisocial content (including expressions that are excessively violent, explicitly sexual or may lead to discrimination);
(4) Bullying, harassment or any other act of obstructing the smooth use of the Service by other Customers (including sending false information or spam or interfering with the communications of other Customers);
(5) Illegal collection or use, or disclosure or provision to a third party, of personal information, other privacy related information, or confidential information such as passwords, of others;
(6) Using the Service to conduct acts for profit (except where approved in advance in writing by Sony), to meet or socialize with strangers of the opposite sex, or to conduct acts for other purposes different from the intended purpose of the Service;
(7) Downloading, distributing, making available for public transmission, modifying, operating, reverse engineering, decompiling, disassembling, erasing, etc. of all or any part of the Service beyond the scope expressly authorized by Sony (including the case of disabling or avoiding functions such as content protection and access control, or intentionally misusing defects in the Service);
(8) Incorporating or executing viruses or other programs or files that interfere with the proper operation of, obstruct/control the operations of, or browse/acquire or damage the data from, information terminals, network devices, systems, etc. managed by Sony or third parties, into or in such information terminals, etc.;
(9) Impeding the normal and smooth operation of the Service by, for example, imposing an excessive burden on the server of the Service or by making an excessive request beyond the scope of the legitimate exercise of the rights under these Terms;
(10) Any other violation of these Terms; or
(11) Other comparable matters deemed inappropriate by Sony.
4-2 If Sony determines that the Customer is in breach of these Terms, Sony may suspend or delete such Customer’s Account or take any other action and shall have no responsibility whatsoever for such action.
4-3 Unless required otherwise by law, Sony has no obligation to monitor the Customer’s online activities on the Service; provided, however, that, to the extent permitted by laws and regulations and for legitimate purposes such as ensuring compliance with the laws and these Terms, Sony may record online activities on the Service and browse and disclose the same.
5. Intellectual Property Rights
5-1 Intellectual property rights and other rights relating to the Service are owned or controlled by Sony or the original right holder who licensed Sony (the “Original Rights Holder”).
5-2 The Service may include software for which the Original Rights Holder has set different terms of use from these Terms. If Sony notifies such terms of use within the Service, the Customer shall use the Service in accordance with such terms of use as well.
5-3 The Customer hereby grants Sony the non-exclusive right (with the right to sublicense the same) to use any image, sound, text or other information posted or transmitted by the Customer in connection with the Service (the “Posted Content”) (such use includes reproduction, distribution, public transmission, partial omission and other adaptations), in the entire Service area, without charge, by Sony or any party designated by Sony, to the extent permitted by applicable laws. The Customer also agrees to waive or not to exercise any moral rights of the author regarding the Posted Content. It is the Customer’s responsibility to confirm that the Posted Content does not infringe upon the rights of third parties and otherwise conforms to the contents of these Terms.
5-4 Sony may take any action, including deletion from the Service, regarding any Posted Content that Sony deems to be in violation of these Terms or to be inappropriate, without any notice to the Customer. Sony shall not be liable to the Customer for such action.
6. Change, Suspension, Termination of the Service
6-1 Sony may, at its discretion, modify or terminate the Service, in whole or in part. In connection with such modifications, it may be necessary for the Customer to update the Service, including the software therefor, as a condition to continue using the Service.
6-2 Sony may suspend the provision of the Service in whole or in part for the necessary period of time if any of the following applies:
(1)When there is an interruption in the provision of third-party services (including, without limitation, telecommunications services and cloud services) that are necessary to provide the Service;
(2) When it is necessary to suspend the Service in order to perform maintenance and/or inspection of the system necessary for provision of the Service or to deal with its failure, defect, etc.;
(3) If the Service cannot be provided due to a power outage, natural disaster, labor dispute or other force majeure event; or
(4) When Sony deems it unavoidable.
6-3 Except in the case of emergency, Sony will notify the Customer prior to any change, suspension or termination of all or any part of the Service if such change, suspension or termination would have a significant impact on the Customer.
6-4 Sony shall not be liable for any damages or other consequences incurred by the Customer in connection with any change, suspension or termination of the Service, except where such damages or consequences are attributable to Sony.
7. Disclaimer
7-1 Except to the extent prohibited by applicable laws, Sony makes no representation or warranty, either express or implied, with respect to the accuracy, safety and any other matters of the contents of third-party websites and services that may be accessed via a link from the Service, including advertisements on the Service. Sony shall not be liable for any damages or other consequences arising from the Customer’s use of such websites or services.
7-2 If any dispute arises between the Customer and a third party due to infringement of rights or for any other reason in connection with the Customer’s use of the Service, the Customer shall resolve such dispute at his/her own expense and responsibility, and Sony shall not be held liable in any way.
7-3 Except to the extent prohibited by applicable laws, Sony makes no representations and warranties, either express or implied, with respect to the quality or any other aspects of the Service (including defects such as bugs, security defects and infringement of the rights of third parties).
7-4 Notwithstanding any other provision of these Terms, and to the extent permitted by applicable laws, in the event of any damages suffered by the Customer due to Sony’s default or tort, Sony shall be liable for such damages only to the extent of the damage normally incurred by the Customer and up to the total amount of usage fees Sony received from the Customer, and shall not be liable for any consequential damages, indirect damages or other damages arising from special circumstances (including cases that are foreseen or foreseeable). However, Sony will not be exempted from liability for damages of the Customer due to Sony’s default or tort resulting from its willful misconduct or gross negligence.
7-5 The Service is provided by Sony to the Customer under the contract between Sony and the Customer based on these Terms, and the Original Rights Holder shall not be held liable in any way to the Customer regarding the Service, unless otherwise provided by law.
8. Assignment
8-1 The Customer may not assign, cause to be succeeded, or provide for the purpose of collateral to a third party, all or part of the status or rights and obligations under these Terms.
8-2 The Customer agrees that Sony may transfer or cause the succession of the status or rights and obligations under these Terms and any information about the Customers to a third party in connection with the transfer or succession of the business relating to the Services to such third party.
9. Changes to These Terms
Sony may change these Terms at any time to the extent permitted by law. Sony will notify Customers of the revised Terms through the website of the Service with a prior notice period that Sony deems reasonable considering the changes, etc.; provided, however, that such prior notice period may not be set if the changes are in accordance with the general interest of the Customers.
10. Contact for Inquiries
If the Customer has any questions about these Terms, he/she should contact us by using the contact form on the website of the Service. Sony may confirm the identity of the Customer by the method prescribed by Sony. Unless otherwise required by law, Sony may use any method deemed appropriate by Sony to respond to or otherwise cope with Customer inquiries.
11. Governing Law, Jurisdiction, Class or Representative Action Waiver, and Jury Waiver
11-1 These Terms (including any relevant non-contractual obligations) shall be governed by and construed in accordance with the laws of Japan. All controversies and disputes arising out of or relating to the Service (including any relevant non-contractual obligations) shall be submitted to the Tokyo District Court in Tokyo, Japan as the court of exclusive jurisdiction in the first instance.
11-2 By agreeing to these Terms, Customer agrees that Customer is required to resolve any claim that Customer may have against Sony related to the Service or these Terms on an individual basis. Customer agrees to waive any right Customer may otherwise have to bring any class, collective or representative action, and is precluded from participating in or recovering relief under any current or future class, collective, consolidated or representative action against Sony by someone else. Sony and Customer also agree to waive any right to a trial by jury.
12. Miscellaneous
12-1 Any information, notice or communication from Sony to Customers regarding the Service shall be made by posting on the website of the Service or any other method as Sony deems appropriate. If the Customer provides an email address, Customer shall be deemed to have consented to receiving information, notices and communications at that email address, and such electronic delivery will satisfy any legal communication requirements, including that such communications be in writing. Sony shall not be liable for any damages or other consequences of non-delivery or delay of such information, notice or communication, except where such damages or consequences are attributable to Sony.
12-2 If any portion of these Terms is deemed invalid, void or for any reason unenforceable, such portion shall be deemed severable and shall not affect the validity and enforceability of any remaining portion.
12-3 The Original Rights Holder shall be treated as the third-party beneficiary of these Terms and may directly exercise the relevant rights or invoke the waiver of liability under these Terms.
12-4 In addition to the English version, these Terms may be translated into the language of the Service area. If there is any inconsistency in the meaning or wording between the English version and the translated version, the English version shall prevail.

(1) Infringing the rights or legally protected interests (including intellectual property rights, trade secrets, honors, privacy rights, portrait rights, publicity rights and proprietary rights) of Sony or third parties;
(2) Violating laws, regulations, court decisions or other legally binding dispositions by a public authority, or offending public order and morals;
(3) Insulting, defaming, slandering Sony or any third party, or in the public domain of the Service, or uploading or transmitting by other means any expression or other information that includes offensive or antisocial content (including expressions that are excessively violent, explicitly sexual or may lead to discrimination);
(4) Bullying, harassment or any other act of obstructing the smooth use of the Service by other Customers (including sending false information or spam or interfering with the communications of other Customers);
(5) Illegal collection or use, or disclosure or provision to a third party, of personal information, other privacy related information, or confidential information such as passwords, of others;
(6) Using the Service to conduct acts for profit (except where approved in advance in writing by Sony), to meet or socialize with strangers of the opposite sex, or to conduct acts for other purposes different from the intended purpose of the Service;
(7) Downloading, distributing, making available for public transmission, modifying, operating, reverse engineering, decompiling, disassembling, erasing, etc. of all or any part of the Service beyond the scope expressly authorized by Sony (including the case of disabling or avoiding functions such as content protection and access control, or intentionally misusing defects in the Service);
(8) Incorporating or executing viruses or other programs or files that interfere with the proper operation of, obstruct/control the operations of, or browse/acquire or damage the data from, information terminals, network devices, systems, etc. managed by Sony or third parties, into or in such information terminals, etc.;
(9) Impeding the normal and smooth operation of the Service by, for example, imposing an excessive burden on the server of the Service or by making an excessive request beyond the scope of the legitimate exercise of the rights under these Terms;
(10) Any other violation of these Terms; or
(11) Other comparable matters deemed inappropriate by Sony.
4-2 If Sony determines that the Customer is in breach of these Terms, Sony may suspend or delete such Customer’s Account or take any other action and shall have no responsibility whatsoever for such action.
4-3 Unless required otherwise by law, Sony has no obligation to monitor the Customer’s online activities on the Service; provided, however, that, to the extent permitted by laws and regulations and for legitimate purposes such as ensuring compliance with the laws and these Terms, Sony may record online activities on the Service and browse and disclose the same.
5. Intellectual Property Rights
5-1 Intellectual property rights and other rights relating to the Service are owned or controlled by Sony or the original right holder who licensed Sony (the “Original Rights Holder”).
5-2 The Service may include software for which the Original Rights Holder has set different terms of use from these Terms. If Sony notifies such terms of use within the Service, the Customer shall use the Service in accordance with such terms of use as well.
5-3 The Customer hereby grants Sony the non-exclusive right (with the right to sublicense the same) to use any image, sound, text or other information posted or transmitted by the Customer in connection with the Service (the “Posted Content”) (such use includes reproduction, distribution, public transmission, partial omission and other adaptations), in the entire Service area, without charge, by Sony or any party designated by Sony, to the extent permitted by applicable laws. The Customer also agrees to waive or not to exercise any moral rights of the author regarding the Posted Content. It is the Customer’s responsibility to confirm that the Posted Content does not infringe upon the rights of third parties and otherwise conforms to the contents of these Terms.
5-4 Sony may take any action, including deletion from the Service, regarding any Posted Content that Sony deems to be in violation of these Terms or to be inappropriate, without any notice to the Customer. Sony shall not be liable to the Customer for such action.
6. Change, Suspension, Termination of the Service
6-1 Sony may, at its discretion, modify or terminate the Service, in whole or in part. In connection with such modifications, it may be necessary for the Customer to update the Service, including the software therefor, as a condition to continue using the Service.
6-2 Sony may suspend the provision of the Service in whole or in part for the necessary period of time if any of the following applies:
(1)When there is an interruption in the provision of third-party services (including, without limitation, telecommunications services and cloud services) that are necessary to provide the Service;
(2) When it is necessary to suspend the Service in order to perform maintenance and/or inspection of the system necessary for provision of the Service or to deal with its failure, defect, etc.;
(3) If the Service cannot be provided due to a power outage, natural disaster, labor dispute or other force majeure event; or
(4) When Sony deems it unavoidable.
6-3 Except in the case of emergency, Sony will notify the Customer prior to any change, suspension or termination of all or any part of the Service if such change, suspension or termination would have a significant impact on the Customer.
6-4 Sony shall not be liable for any damages or other consequences incurred by the Customer in connection with any change, suspension or termination of the Service, except where such damages or consequences are attributable to Sony.
7. Disclaimer
7-1 Except to the extent prohibited by applicable laws, Sony makes no representation or warranty, either express or implied, with respect to the accuracy, safety and any other matters of the contents of third-party websites and services that may be accessed via a link from the Service, including advertisements on the Service. Sony shall not be liable for any damages or other consequences arising from the Customer’s use of such websites or services.
7-2 If any dispute arises between the Customer and a third party due to infringement of rights or for any other reason in connection with the Customer’s use of the Service, the Customer shall resolve such dispute at his/her own expense and responsibility, and Sony shall not be held liable in any way.
7-3 Except to the extent prohibited by applicable laws, Sony makes no representations and warranties, either express or implied, with respect to the quality or any other aspects of the Service (including defects such as bugs, security defects and infringement of the rights of third parties).
7-4 Notwithstanding any other provision of these Terms, and to the extent permitted by applicable laws, in the event of any damages suffered by the Customer due to Sony’s default or tort, Sony shall be liable for such damages only to the extent of the damage normally incurred by the Customer and up to the total amount of usage fees Sony received from the Customer, and shall not be liable for any consequential damages, indirect damages or other damages arising from special circumstances (including cases that are foreseen or foreseeable). However, Sony will not be exempted from liability for damages of the Customer due to Sony’s default or tort resulting from its willful misconduct or gross negligence.
7-5 The Service is provided by Sony to the Customer under the contract between Sony and the Customer based on these Terms, and the Original Rights Holder shall not be held liable in any way to the Customer regarding the Service, unless otherwise provided by law.
8. Assignment
8-1 The Customer may not assign, cause to be succeeded, or provide for the purpose of collateral to a third party, all or part of the status or rights and obligations under these Terms.
8-2 The Customer agrees that Sony may transfer or cause the succession of the status or rights and obligations under these Terms and any information about the Customers to a third party in connection with the transfer or succession of the business relating to the Services to such third party.
9. Changes to These Terms
Sony may change these Terms at any time to the extent permitted by law. Sony will notify Customers of the revised Terms through the website of the Service with a prior notice period that Sony deems reasonable considering the changes, etc.; provided, however, that such prior notice period may not be set if the changes are in accordance with the general interest of the Customers.
10. Contact for Inquiries
If the Customer has any questions about these Terms, he/she should contact us by using the contact form on the website of the Service. Sony may confirm the identity of the Customer by the method prescribed by Sony. Unless otherwise required by law, Sony may use any method deemed appropriate by Sony to respond to or otherwise cope with Customer inquiries.
11. Governing Law, Jurisdiction, Class or Representative Action Waiver, and Jury Waiver
11-1 These Terms (including any relevant non-contractual obligations) shall be governed by and construed in accordance with the laws of Japan. All controversies and disputes arising out of or relating to the Service (including any relevant non-contractual obligations) shall be submitted to the Tokyo District Court in Tokyo, Japan as the court of exclusive jurisdiction in the first instance.
11-2 By agreeing to these Terms, Customer agrees that Customer is required to resolve any claim that Customer may have against Sony related to the Service or these Terms on an individual basis. Customer agrees to waive any right Customer may otherwise have to bring any class, collective or representative action, and is precluded from participating in or recovering relief under any current or future class, collective, consolidated or representative action against Sony by someone else. Sony and Customer also agree to waive any right to a trial by jury.
12. Miscellaneous
12-1 Any information, notice or communication from Sony to Customers regarding the Service shall be made by posting on the website of the Service or any other method as Sony deems appropriate. If the Customer provides an email address, Customer shall be deemed to have consented to receiving information, notices and communications at that email address, and such electronic delivery will satisfy any legal communication requirements, including that such communications be in writing. Sony shall not be liable for any damages or other consequences of non-delivery or delay of such information, notice or communication, except where such damages or consequences are attributable to Sony.
12-2 If any portion of these Terms is deemed invalid, void or for any reason unenforceable, such portion shall be deemed severable and shall not affect the validity and enforceability of any remaining portion.
12-3 The Original Rights Holder shall be treated as the third-party beneficiary of these Terms and may directly exercise the relevant rights or invoke the waiver of liability under these Terms.
12-4 In addition to the English version, these Terms may be translated into the language of the Service area. If there is any inconsistency in the meaning or wording between the English version and the translated version, the English version shall prevail.

Terms of Service


These Terms of Service (these “Terms”) set forth the terms and conditions of use of the service “Sword Art Online -EX-CHRONICLE- Online Edition” (the “Service”) provided by Sony Music Solutions Inc. (“Sony”) for customers in the Service area (the “Customer”).
Sony may set separate terms and conditions related to the Service (including terms of use to be additionally applied to parts of the Service, operational rules to be separately notified within the Service) (the “Individual Terms”; which shall be deemed to constitute a part of these Terms except when otherwise specifically referred to), and the Customer shall also use the Service in accordance with the Individual Terms. If there is any discrepancy between these Terms and the Individual Terms or the contents of other websites, these Terms shall prevail unless otherwise specified.
If the Customer is a minor in the country or region that the Service is used, such Customer must obtain consent to these Terms from his/her parent or guardian or have the required parent or guardian consent to these Terms on his/her behalf, in accordance with the laws of such country or region, before using the Service.
1. Service
1-1 Related data and documents, etc. and their updated/upgraded versions also constitute part of the Service.
1-2 Sony may place advertisements for Sony and third parties anywhere on the Service.
1-3 An Internet environment is required to use the Service. The Customer shall be responsible for setting up and maintenance of such Internet environment at such Customer’s own expense, including bearing the burden of communication charges and ensuring network security.
1-4 The Service is not intended to be used for the purpose of backup or storage of any data. Sony shall not be liable in any way for loss, alteration or the like of data contained in the Services, or inability to access, use, upload or download data contained in the Services except where tickets, etc. purchased by Customers are lost or otherwise become unable to be used due to reasons attributable to Sony, nor shall Sony be liable in the event of deletion of a user account, or for alteration, interruption or termination of the Services.
1-5 Parts of the Service may be provided for a fee, and prices and payment terms will be announced on the website for the Service. Except as required by law, fees paid for the Service will not be refunded.
2. User Account
2-1 To use the Service, the Customer shall properly provide Sony with the required information and create a user account (the “Account”). The Customer may also create an Account by using a user account for other services (including third party services) designated by Sony. If Sony believes that any of the following applies or the provision of the Service is otherwise impossible or inappropriate, Sony may refuse to create an Account, delete the Account already created or take any other measures that Sony deems appropriate.
(1) If the Customer is a minor in the Service area and has not obtained the consent of a statutory agent or required proxy to use the Service as required under the laws regarding the Service area.
(2) If the Customer provides Sony with information inconsistent with the facts, such as by using another person’s name or making a false statement.
(3) If the Customer has violated these Terms or any applicable laws and regulations during the use of the Service or in the past.
(4) If the Customer falls under the category of an organized crime group, a member of an organized crime group, those who were a member of an organized crime group in the past five years, an associate member of an organized crime group, a racketeer, a group engaging in criminal activities under the pretext of conducting social campaigns, a crime group specialized in intellectual crimes, etc., any other person equivalent to these, a person designated by the Japanese government or a foreign government as subject to economic sanctions, or a resident of a country or region designated by the Japanese government or foreign governments as subject to economic sanctions (collectively “Anti-Social Forces”), or a juridical person which has Anti-Social Forces involved in the management thereof.
(5) If the Customer has already created an Account.
2-2 If any information provided by the Customer to Sony in connection with the use of the Service is changed, the Customer shall carry out the change procedure without delay in the manner prescribed by Sony.
2-3 The Customer shall not use another Customer’s Account to use the Service and shall not allow any third party to use such Customer’s Account.
2-4 The Customer shall properly manage the information related to such Customer’s own Account, including the ID and password. The Customer shall be responsible for all acts and results of using the Service with such Customer’s own Account.
2-5 The Customer may withdraw from the Service (delete such Customer’s Account) at any time through the procedures prescribed by Sony. Upon withdrawal, the Customer shall lose all rights under these Terms; however, these Terms shall continue to apply even after such withdrawal to the matters related to the use of the Service by the Customer prior to the withdrawal.
3. Privacy
The Customer’s information acquired by Sony in connection with the Service shall be treated in accordance with Sony’s Privacy Policy.
4. Prohibited Matters
4-1 In using the Service, the Customer shall not attempt or conduct any of the following acts and shall not cooperate with or promote any of such acts by any third party.
(1) Infringing the rights or legally protected interests (including intellectual property rights, trade secrets, honors, privacy rights, portrait rights, publicity rights and proprietary rights) of Sony or third parties;
(2) Violating laws, regulations, court decisions or other legally binding dispositions by a public authority, or offending public order and morals;

4-3 Unless required otherwise by law, Sony has no obligation to monitor the Customer’s online activities on the Service; provided, however, that, to the extent permitted by laws and regulations and for legitimate purposes such as ensuring compliance with the laws and these Terms, Sony may record online activities on the Service and browse and disclose the same.

本使用條款(下稱「本條款」)係為Sony Music Solutions Inc.(下稱「Sony」)經營之服務「Sword Art Online -EX-CHRONICLE- Online Edition」(下稱「本服務」)所制訂之使用條件,適用於本服務提供區域內使用本服務之客戶(下稱「客戶」)。
Sony另制訂有本服務相關個別條款等(包含就本服務特定部分追加適用之使用條件、本服務內所通知之操作規則等,下稱「個別條款等」。以下除個別敘明者外,個別條款等均內含於本條款。)時,客戶應遵守個別條款等使用本服務。個別條款等、其他網站等之記載等與本條款內容相異時,除有特別規定外,以本條款為優先。
客戶於使用本服務所在國家或地區內為未成年人時,請依該國家或地區之法律,於取得監護人對於本條款之同意或必要時由監護人代理同意本條款後始使用本服務。
1. 本服務
1-1 本服務由相關資料、文件等及渠等之更新、升級版構成本服務之部分。
1-2 Sony得於本服務任何地方刊載Sony及第三人的廣告。
1-3 使用本服務需要網際網路環境。客戶應自行承擔費用及責任整備網際網路環境、負擔通信費用、確保安全性等。
1-4 本服務不預設為任何資料備份、保管之目的而使用。除因可歸責於Sony之事由致客戶所購入之票券等消失等外,Sony對於本服務內之資料消失或變更等、無法連接、使用或上傳/下載本服務內資料等均不負任何責任,對於用戶帳號之刪除、本服務變更、中斷或終止之情形亦同。
1-5 本服務之一部分為付費服務,其價格、付費條件等將於本服務網站等說明。除法令另有要求外,本服務相關已支付之使用費用不予退款。
2. 用戶帳號
2-1擬使用本服務者,應正確提供Sony所規定之必要資訊予Sony,開設為使用本服務之用戶帳號(下稱「帳號」)。此外,客戶得使用Sony另指定之其他服務(包含第三人之服務)之用戶帳號開設帳號。但Sony認為有下列情形之虞時,或判斷無法或不宜提供本服務時,得拒絕帳號之開設,且即便於帳號開設後,亦得採取刪除帳號等措施。
(1) 擬使用人於本服務提供區域內係未成年人,且就本服務之使用未依本服務提供區域之相關法律取得必要之監護人同意或由其代理。
(2) 擬使用人向Sony提供不符事實之資訊,例如使用他人名義、不實記載等。
(3) 擬使用人使用本服務時或其過去曾有違反本條款或所適用法令之行為者。
(4) 擬使用人係犯罪組織、犯罪組織成員、失去犯罪組織成員身分尚未滿5年、犯罪組織準成員、職業股東、偽稱社會運動而從事不法行為等者、特殊智慧犯罪集團或其他與此相當者、日本政府或外國政府指定為經濟制裁對象、日本政府或外國政府指定為經濟制裁對象國家或地區之居民(下合稱「反社會勢力等」),或屬此等反社會勢力等實質上涉及經營之法人等。
(5) 擬使用人已開設帳號。
2-2 使用本服務期間,客戶已提供予Sony之資訊發生變更時,客戶應儘速依照Sony規定之方法進行變更程序。
2-3 客戶不得使用其他客戶之帳號使用本服務,且不得將其自身帳號供第三人使用。
2-4 客戶應適當管理其帳號相關資訊,包含ID、密碼等。客戶應對於其自身帳號使用本服務所為之一切行為負責。
2-5 客戶隨時得依Sony規定之程序退出本服務(刪除用戶帳號)。客戶將因退出而喪失本條款上之所有權利。但客戶於退出前使用本服務之相關事項,於客戶退出後仍適用本條款。
3. 隱私權
Sony因與本服務相關而取得之客戶相關資訊之處理依Sony隱私權政策辦理。
4. 禁止事項
4-1 客戶使用本服務時,不得嘗試或從事下列行為,且不得協助或助長第三人從事該等行為。
(1) 侵害Sony或第三人之權利或法律上受保護之利益(包含智慧財產權、營業秘密、名譽、隱私權、肖像權、公開發表權、所有權)。
(2) 違反法令、法院判決、其他公機關作成具法拘束力之處分或公序良俗。
(3)對Sony或第三人,或於本服務公開領域上傳或以其他手段發送/傳達侮辱、毀損名譽、誹謗,或含有造成他人不快或反社會性內容之表現(過度暴力之表現、露骨的性表意、恐涉有歧視之表現)等之資訊。
(4) 霸凌、騷擾、或其他妨害其他客戶順利使用本服務之行為(包含發送不實資訊、垃圾訊息、妨害其他客戶之溝通)。
(5) 不正蒐集、利用或公開涉及他人個人資料或其他隱私之資訊、密碼等機密資訊,或將該等資訊提供予第三人。
(6) 利用本服務從事以營利為目的之行為(事前經Sony書面同意者除外)、以與素未謀面之異性邂逅、交往為目的之行為、或為其他以異於本服務預設使用目的所為之行為。
(7) 超出Sony明示允許之範圍就本服務之全部或部分進行下載、散布、公開傳輸、改變或操作、逆向工程、反向編譯、反向組裝、刪除等(包含使內容保護、存取控管等功能無效或迴避該等措施之情形、故意利用本服務之瑕疵等情形)。
(8)對於Sony或第三人管理之訊息終端、網絡設備、系統等,植入或執行阻礙其適當運作、妨害/控制其操控、瀏覽/取得或毀損資料等之病毒或其他程式、檔案等。
(9) 阻礙本服務之正常順利營運,例如造成本服務之伺服器等過大負擔,或提出超出本條款所定正當權利行使範圍之過度要求等。
(10) 其他違反本條款之事項。
(11)其他Sony認為不適當之事項。
4-2 Sony認為客戶違反本條款時,得暫停、刪除帳號或採取其他措施,並就該等措施,對客戶不負任何責任。
4-3 除法令另有要求外,Sony不負監視客戶在本服務上之線上活動之義務。但出於法令或遵守本條款等之正當目的,Sony得於法令允許之範圍內記錄、查看、揭露本服務上之線上活動。
5. 智慧財產權等
5-1 本服務相關智慧財產權及其他權利屬於Sony或授權予Sony使用之原權利人(下稱「原權利人」)所有。
5-2 本服務可能含有由原權利人制訂與本條款不同使用條件之軟體。Sony於本服務內通知該使用條件時,客戶應依該使用條件使用本服務。
5-3 客戶於所適用法律之容許範圍內,向Sony授權,Sony或Sony所指定之人於所有本服務提供區域內無償、非排他性自由使用(包含複製、散布、公開傳輸、一部省略及其他改作)與本服務相關其所發布或傳輸等之圖片、聲音、文章及其他資訊(下合稱「發布內容」)之權利(包含再授權之權利),客戶亦放棄或不得行使該等發布內容相關著作人格權。此外,客戶應自行負責確認發布內容不侵害第三人權利,並且符合本條款之內容。
5-4 Sony得不經通知客戶,即自本服務上刪除其判斷為違反本條款或不適當之發布內容,並就該等措施,對客戶不負任何責任。
6. 本服務之變更、中斷、終止
6-1 Sony得依其裁量,變更或終止本服務之全部或一部。此外,有關該等變更,有可能以更新本服務等作為繼續使用本服務之條件。
6-2有下列情形之一者,Sony得於必要期間中斷提供本服務之全部或一部。
(1)提供本服務所必要之第三人服務(包含但不限於電信服務、雲端服務)中斷時。
(2) 為實施提供本服務所必要之系統維護/檢查,或為處理其發生之故障/瑕疵等,而必須中斷本服務時。
(3) 因停電、自然災害、勞動爭議或其他不可抗力致無法提供本服務時。
(4) 其他Sony認為不可避免之情形。
6-3 本服務之全部或一部之變更/中斷/終止將大幅影響客戶時,除有緊急情形外,Sony應事先通知客戶後再進行。
6-4 Sony對於本服務之變更/中斷/終止相關致生於客戶之損害及其他結果,除因可歸責Sony之事由所生者外,不負任何責任。
7. 免責事項
7-1 Sony對由本服務(包含本服務上的廣告)連結之可轉換之第三人網站、服務內容等之正確性、安全性或其他任何事項,不為任何明示或默示之保證。對於客戶使用該等網站或服務等所受之任何損害或其他結果,Sony不負任何責任。
7-2 客戶就其使用本服務相關而與第三人間因權利侵害或其他事由發生糾紛時,客戶應自行承擔費用及責任解決,Sony不負任何責任。
7-3 Sony對於本服務之品質或其他任何事項(包含程式錯誤等瑕疵、安全性等相關缺陷、及是否侵害第三人權利),不為任何明示或默示之保證。
7-4 如因Sony之債務不履行或侵權行為而對客戶造成損害時,於所適用法律之容許範圍內,Sony以客戶通常會發生之損害範圍為限,且以Sony自客戶受領之使用費用之總額為上限,負損害賠償責任,不受本條款其他規定限制。Sony就結果損害、間接損害或其他因特殊情況所生之損害等(包含已預見或可得預見損害發生之情形),不負任何責任。但對於因Sony之故意或重大過失所生債務不履行或侵權行為導致客戶受有損害之賠償責任,Sony不得免責。
7-5 本服務係基於Sony與客戶間以本條款為內容所成立之契約,由Sony向客戶提供,除法令另有規定外,原權利人對客戶不負本服務相關之任何責任。
8. 本條款上之地位轉讓等
8-1 客戶不得將本條款所享地位或權利義務之全部或一部讓與予第三人、使第三人繼受、或供作擔保。
8-2 Sony得於讓與本服務相關事業予第三人或使第三人繼受時,將本條款上之地位及權利義務及其他客戶相關資訊等讓與該第三人或使其繼受,客戶事先予以同意。
9. 本條款之變更
Sony於法令容許之範圍內,得隨時變更本條款。Sony在變更後之本條款開始適用前,應依變更內容等判斷,設定合理之事前告知期間後(但本條款之變更內容係符合客戶一般利益時,得不設定事前告知期間),將變更後之本條款透過本服務之網站周知客戶。
10. 聯繫窗口
對於本條款有疑問等時,請與下列窗口聯繫。此外,Sony得依Sony所定之方法進行客戶之本人確認。此外,對於諮詢之回答及其他回應,除法令另有要求外,Sony得依其認為適當之方法辦理。

11. 準據法及訴訟管轄
本條款之準據法依日本法。客戶與Sony間就本服務相關有訴訟之必要時,應以東京地方法院為第一審專屬合意管轄法院。
12. 其他
12-1 Sony向客戶發出本服務相關之說明、通知或聯絡,應以於本服務網站上刊載之標示或其他Sony認為適當之方法為之。此外,Sony就說明等未送達、遲延等所生損害或其他結果,除因可歸責於Sony之事由所致者外,不負任何責任。
12-2 即使本條款之部分經認為無效,本條款之其餘部分仍為有效,不受其影響。
12-3 原權利人應作為本條款之利益第三人,並得直接行使本條款上之相關權利或援用免責條款。
12-4 除[英文版]外,本條款亦有可能翻譯為本服務提供區域之語言,但[英文版]與翻譯版本之文意或用詞上有所出入時,以英文版為準。

Terms of Service


These Terms of Service (these “Terms”) set forth the terms and conditions of use of the service “Sword Art Online -EX-CHRONICLE- Online Edition” (the “Service”) provided by Sony Music Solutions Inc. (“Sony”) for customers in the Service area (the “Customer”).
Sony may set separate terms and conditions related to the Service (including terms of use to be additionally applied to parts of the Service, operational rules to be separately notified within the Service) (the “Individual Terms”; which shall be deemed to constitute a part of these Terms except when otherwise specifically referred to), and the Customer shall also use the Service in accordance with the Individual Terms. If there is any discrepancy between these Terms and the Individual Terms or the contents of other websites, these Terms shall prevail unless otherwise specified.
If the Customer is a minor in the country or region that the Service is used, such Customer must obtain consent to these Terms from his/her parent or guardian or have the required parent or guardian consent to these Terms on his/her behalf, in accordance with the laws of such country or region, before using the Service.
1. Service
1-1 Related data and documents, etc. and their updated/upgraded versions also constitute part of the Service.
1-2 Sony may place advertisements for Sony and third parties anywhere on the Service.
1-3 An Internet environment is required to use the Service. The Customer shall be responsible for setting up and maintenance of such Internet environment at such Customer’s own expense, including bearing the burden of communication charges and ensuring network security.
1-4 The Service is not intended to be used for the purpose of backup or storage of any data. Sony shall not be liable in any way for loss, alteration or the like of data contained in the Services, or inability to access, use, upload or download data contained in the Services except where tickets, etc. purchased by Customers are lost or otherwise become unable to be used due to reasons attributable to Sony, nor shall Sony be liable in the event of deletion of a user account, or for alteration, interruption or termination of the Services.
1-5 Parts of the Service may be provided for a fee, and prices and payment terms will be announced on the website for the Service. Except as required by law, fees paid for the Service will not be refunded.
2. User Account
2-1 To use the Service, the Customer shall properly provide Sony with the required information and create a user account (the “Account”). The Customer may also create an Account by using a user account for other services (including third party services) designated by Sony. If Sony believes that any of the following applies or the provision of the Service is otherwise impossible or inappropriate, Sony may refuse to create an Account, delete the Account already created or take any other measures that Sony deems appropriate.
(1) If the Customer is a minor in the Service area and has not obtained the consent of a statutory agent or required proxy to use the Service as required under the laws regarding the Service area.
(2) If the Customer provides Sony with information inconsistent with the facts, such as by using another person’s name or making a false statement.
(3) If the Customer has violated these Terms or any applicable laws and regulations during the use of the Service or in the past.
(4) If the Customer falls under the category of an organized crime group, a member of an organized crime group, those who were a member of an organized crime group in the past five years, an associate member of an organized crime group, a racketeer, a group engaging in criminal activities under the pretext of conducting social campaigns, a crime group specialized in intellectual crimes, etc., any other person equivalent to these, a person designated by the Japanese government or a foreign government as subject to economic sanctions, or a resident of a country or region designated by the Japanese government or foreign governments as subject to economic sanctions (collectively “Anti-Social Forces”), or a juridical person which has Anti-Social Forces involved in the management thereof.
(5) If the Customer has already created an Account.
2-2 If any information provided by the Customer to Sony in connection with the use of the Service is changed, the Customer shall carry out the change procedure without delay in the manner prescribed by Sony.
2-3 The Customer shall not use another Customer’s Account to use the Service and shall not allow any third party to use such Customer’s Account.
2-4 The Customer shall properly manage the information related to such Customer’s own Account, including the ID and password. The Customer shall be responsible for all acts and results of using the Service with such Customer’s own Account.
2-5 The Customer may withdraw from the Service (delete such Customer’s Account) at any time through the procedures prescribed by Sony. Upon withdrawal, the Customer shall lose all rights under these Terms; however, these Terms shall continue to apply even after such withdrawal to the matters related to the use of the Service by the Customer prior to the withdrawal.
3. Privacy
The Customer’s information acquired by Sony in connection with the Service shall be treated in accordance with Sony’s Privacy Policy.
4. Prohibited Matters
4-1 In using the Service, the Customer shall not attempt or conduct any of the following acts and shall not cooperate with or promote any of such acts by any third party.
(1) Infringing the rights or legally protected interests (including intellectual property rights, trade secrets, honors, privacy rights, portrait rights, publicity rights and proprietary rights) of Sony or third parties;
(2) Violating laws, regulations, court decisions or other legally binding dispositions by a public authority, or offending public order and morals;
(3) Insulting, defaming, slandering Sony or any third party, or in the public domain of the Service, or uploading or transmitting by other means any expression or other information that includes offensive or antisocial content (including expressions that are excessively violent, explicitly sexual or may lead to discrimination);
(4) Bullying, harassment or any other act of obstructing the smooth use of the Service by other Customers (including sending false information or spam or interfering with the communications of other Customers);
(5) Illegal collection or use, or disclosure or provision to a third party, of personal information, other privacy related information, or confidential information such as passwords, of others;
(6) Using the Service to conduct acts for profit (except where approved in advance in writing by Sony), to meet or socialize with strangers of the opposite sex, or to conduct acts for other purposes different from the intended purpose of the Service;
(7) Downloading, distributing, making available for public transmission, modifying, operating, reverse engineering, decompiling, disassembling, erasing, etc. of all or any part of the Service beyond the scope expressly authorized by Sony (including the case of disabling or avoiding functions such as content protection and access control, or intentionally misusing defects in the Service);
(8) Incorporating or executing viruses or other programs or files that interfere with the proper operation of, obstruct/control the operations of, or browse/acquire or damage the data from, information terminals, network devices, systems, etc. managed by Sony or third parties, into or in such information terminals, etc.;
(9) Impeding the normal and smooth operation of the Service by, for example, imposing an excessive burden on the server of the Service or by making an excessive request beyond the scope of the legitimate exercise of the rights under these Terms;
(10) Any other violation of these Terms; or
(11) Other comparable matters deemed inappropriate by Sony.
4-2 If Sony determines that the Customer is in breach of these Terms, Sony may suspend or delete such Customer’s Account or take any other action and shall have no responsibility whatsoever for such action.
4-3 Unless required otherwise by law, Sony has no obligation to monitor the Customer’s online activities on the Service; provided, however, that, to the extent permitted by laws and regulations and for legitimate purposes such as ensuring compliance with the laws and these Terms, Sony may record online activities on the Service and browse and disclose the same.
5. Intellectual Property Rights
5-1 Intellectual property rights and other rights relating to the Service are owned or controlled by Sony or the original right holder who licensed Sony (the “Original Rights Holder”).
5-2 The Service may include software for which the Original Rights Holder has set different terms of use from these Terms. If Sony notifies such terms of use within the Service, the Customer shall use the Service in accordance with such terms of use as well.
5-3 The Customer hereby grants Sony the non-exclusive right (with the right to sublicense the same) to use any image, sound, text or other information posted or transmitted by the Customer in connection with the Service (the “Posted Content”) (such use includes reproduction, distribution, public transmission, partial omission and other adaptations), in the entire Service area, without charge, by Sony or any party designated by Sony, to the extent permitted by applicable laws. The Customer also agrees to waive or not to exercise any moral rights of the author regarding the Posted Content. It is the Customer’s responsibility to confirm that the Posted Content does not infringe upon the rights of third parties and otherwise conforms to the contents of these Terms.
5-4 Sony may take any action, including deletion from the Service, regarding any Posted Content that Sony deems to be in violation of these Terms or to be inappropriate, without any notice to the Customer. Sony shall not be liable to the Customer for such action.
6. Change, Suspension, Termination of the Service
6-1 Sony may, at its discretion, modify or terminate the Service, in whole or in part. In connection with such modifications, it may be necessary for the Customer to update the Service, including the software therefor, as a condition to continue using the Service.
6-2 Sony may suspend the provision of the Service in whole or in part for the necessary period of time if any of the following applies:
(1)When there is an interruption in the provision of third-party services (including, without limitation, telecommunications services and cloud services) that are necessary to provide the Service;
(2) When it is necessary to suspend the Service in order to perform maintenance and/or inspection of the system necessary for provision of the Service or to deal with its failure, defect, etc.;
(3) If the Service cannot be provided due to a power outage, natural disaster, labor dispute or other force majeure event; or
(4) When Sony deems it unavoidable.
6-3 Except in the case of emergency, Sony will notify the Customer prior to any change, suspension or termination of all or any part of the Service if such change, suspension or termination would have a significant impact on the Customer.
6-4 Sony shall not be liable for any damages or other consequences incurred by the Customer in connection with any change, suspension or termination of the Service, except where such damages or consequences are attributable to Sony.
7. Disclaimer
7-1 Except to the extent prohibited by applicable laws, Sony makes no representation or warranty, either express or implied, with respect to the accuracy, safety and any other matters of the contents of third-party websites and services that may be accessed via a link from the Service, including advertisements on the Service. Sony shall not be liable for any damages or other consequences arising from the Customer’s use of such websites or services.
7-2 If any dispute arises between the Customer and a third party due to infringement of rights or for any other reason in connection with the Customer’s use of the Service, the Customer shall resolve such dispute at his/her own expense and responsibility, and Sony shall not be held liable in any way.
7-3 Except to the extent prohibited by applicable laws, Sony makes no representations and warranties, either express or implied, with respect to the quality or any other aspects of the Service (including defects such as bugs, security defects and infringement of the rights of third parties).
7-4 Notwithstanding any other provision of these Terms, and to the extent permitted by applicable laws, in the event of any damages suffered by the Customer due to Sony’s default or tort, Sony shall be liable for such damages only to the extent of the damage normally incurred by the Customer and up to the total amount of usage fees Sony received from the Customer, and shall not be liable for any consequential damages, indirect damages or other damages arising from special circumstances (including cases that are foreseen or foreseeable). However, Sony will not be exempted from liability for damages of the Customer due to Sony’s default or tort resulting from its willful misconduct or gross negligence.
7-5 The Service is provided by Sony to the Customer under the contract between Sony and the Customer based on these Terms, and the Original Rights Holder shall not be held liable in any way to the Customer regarding the Service, unless otherwise provided by law.
8. Assignment
8-1 The Customer may not assign, cause to be succeeded, or provide for the purpose of collateral to a third party, all or part of the status or rights and obligations under these Terms.
8-2 The Customer agrees that Sony may transfer or cause the succession of the status or rights and obligations under these Terms and any information about the Customers to a third party in connection with the transfer or succession of the business relating to the Services to such third party.
9. Changes to These Terms
Sony may change these Terms at any time to the extent permitted by law. Sony will notify Customers of the revised Terms through the website of the Service with a prior notice period that Sony deems reasonable considering the changes, etc.; provided, however, that such prior notice period may not be set if the changes are in accordance with the general interest of the Customers.
10. Contact for Inquiries
If the Customer has any questions about these Terms, he/she should contact us by using the contact form on the website of the Service. Sony may confirm the identity of the Customer by the method prescribed by Sony. Unless otherwise required by law, Sony may use any method deemed appropriate by Sony to respond to or otherwise cope with Customer inquiries.
11. Governing Law, Jurisdiction, Class or Representative Action Waiver, and Jury Waiver
11-1 These Terms (including any relevant non-contractual obligations) shall be governed by and construed in accordance with the laws of Japan. All controversies and disputes arising out of or relating to the Service (including any relevant non-contractual obligations) shall be submitted to the Tokyo District Court in Tokyo, Japan as the court of exclusive jurisdiction in the first instance.
11-2 By agreeing to these Terms, Customer agrees that Customer is required to resolve any claim that Customer may have against Sony related to the Service or these Terms on an individual basis. Customer agrees to waive any right Customer may otherwise have to bring any class, collective or representative action, and is precluded from participating in or recovering relief under any current or future class, collective, consolidated or representative action against Sony by someone else. Sony and Customer also agree to waive any right to a trial by jury.
12. Miscellaneous
12-1 Any information, notice or communication from Sony to Customers regarding the Service shall be made by posting on the website of the Service or any other method as Sony deems appropriate. If the Customer provides an email address, Customer shall be deemed to have consented to receiving information, notices and communications at that email address, and such electronic delivery will satisfy any legal communication requirements, including that such communications be in writing. Sony shall not be liable for any damages or other consequences of non-delivery or delay of such information, notice or communication, except where such damages or consequences are attributable to Sony.
12-2 If any portion of these Terms is deemed invalid, void or for any reason unenforceable, such portion shall be deemed severable and shall not affect the validity and enforceability of any remaining portion.
12-3 The Original Rights Holder shall be treated as the third-party beneficiary of these Terms and may directly exercise the relevant rights or invoke the waiver of liability under these Terms.
12-4 In addition to the English version, these Terms may be translated into the language of the Service area. If there is any inconsistency in the meaning or wording between the English version and the translated version, the English version shall prevail.

1-2 โซนี่อาจลงโฆษณาของโซนี่และบุคคลที่สามในส่วนใดของการบริการก็ได้
1-3 ผู้ใช้บริการจำเป็นต้องใช้อินเทอร์เน็ตในการใช้บริการ โดยผู้ใช้บริการต้องเป็นผู้รับผิดชอบในการติดตั้งและรักษาการเชื่อมต่ออินเทอร์เน็ตดังกล่าวด้วยค่าใช้จ่ายของผู้ใช้บริการเอง รวมถึงการรับภาระค่าติดต่อสื่อสาร และความมั่นใจในความปลอดภัยของเครือข่ายด้วยตัวเอง
1-4 บริการนี้ไม่ได้มีวัตถุประสงค์เพื่อใช้เป็นที่สำรองข้อมูลหรือจัดเก็บข้อมูลใด ๆ โซนี่จะไม่รับผิดชอบต่อความเสียหาย การเปลี่ยนแปลง หรือสิ่งอื่นที่คล้ายคลึงกันของข้อมูลที่อยู่ในบริการ หรือการไม่สามารถเข้าถึง ใช้ อัปโหลดหรือดาวน์โหลดข้อมูลที่อยู่ในบริการ เว้นแต่ในกรณีตั๋ว ฯลฯ ที่ผู้ใช้บริการซื้อจะหายหรือไม่สามารถใช้ได้เนื่องจากเหตุที่เกิดจากโซนี่ และโซนี่จะไม่รับผิดชอบในกรณีที่บัญชีผู้ใช้งานถูกลบ หรือมี

2-1 ผู้ใช้บริการต้องให้ข้อมูลที่จำเป็นต่อโซนี่ และสร้างบัญชีผู้ใช้ (“บัญชี”) เพื่อที่จะใช้บริการ โดยผู้ใช้บริการสามารถสร้างบัญชีโดยใช้บัญชีผู้ใช้สำหรับบริการอื่นๆ (รวมถึงบริการของบุคคลที่สาม) ตามที่โซนี่กำหนด ในกรณีที่มีเหตุอันควรเชื่อได้ว่าข้อหนึ่งข้อใดต่อไปนี้เกิดขึ้น หรือการให้บริการไม่สามารถกระทำการได้หรือไม่เหมาะสม โซนี่อาจปฏิเสธที่จะสร้างบัญชี ลบบัญชีที่สร้างไว้แล้ว หรือใช้มาตรการอื่นใดที่โซนี่ เห็นสมควรว่าเหมาะสม
(1) หากผู้ใช้บริการเป็นผู้เยาว์ในขอบเขตพื้นที่ที่ให้บริการ และไม่ได้รับความยินยอมจากผู้แทนตามกฎหมายหรือตัว แทนที่จำเป็นในการใช้บริการตามที่กฎหมายของขอบเขตพื้นที่ที่ให้บริการกำหนด
(2) หากผู้ใช้บริการให้ข้อมูลโดยไม่สอดคล้องกับข้อเท็จจริงต่อโซนี่ เช่น ใช้ชื่อบุคคลอื่น หรือแจ้งข้อมูลอันเป็นเท็จ เป็นต้น
(3) หากผู้ใช้บริการละเมิดข้อตกลงการให้บริการนี้หรือกฎหมายที่มีผลบังคับใช้ใดๆ และข้อบังคับที่ เกี่ยวข้องระหว่างการใช้บริการหรือในอดีต
(4) หากผู้ใช้บริการเข้าข่ายเป็นกลุ่มอาชญากรรม สมาชิกกลุ่มอาชญากรรม ผู้เคยเป็นสมาชิกกลุ่มอาชญากรรมในระยะเวลาห้าปีที่ผ่านมา สมาชิกสมทบของกลุ่มอาชญากรรม ผู้หาเงินจากกิจกรรมผิดกฎหมาย กลุ่มที่มีส่วนร่วมในกิจกรรมอาชญากรรมภายใต้ข้ออ้างในการดำเนินการรณรงค์ทางสังคม กลุ่มอาชญากรรมที่เชี่ยวชาญด้านอาชญากรรมอัจฉริยะ (Intellectual crimes) ฯลฯ บุคคลใดที่มีลักษณะเทียบเท่าที่กล่าวมาข้างต้น บุคคลที่รัฐบาลญี่ปุ่นหรือรัฐบาลต่างชาติกำหนดว่าถูกคว่ำบาตรทางเศรษฐกิจ หรือผู้มีถิ่นที่อยู่ในประเทศหรือภูมิภาคที่รัฐบาลญี่ปุ่นหรือรัฐบาลต่างชาติกำหนดว่าถูก คว่ำบาตรทางเศรษฐกิจ (เรียกรวมกันว่า “กองกำลังต่อต้านสังคม”) หรือนิติบุคคลที่มีกองกำลังต่อต้านสังคมเกี่ยวข้องในการบริหารจัดการด้วย
(5) หากผู้ใช้บริการมีบัญชีอยู่แล้ว
2-2 หากข้อมูลใดๆ เกี่ยวกับการใช้บริการที่ผู้ใช้บริการได้ให้ไว้แก่โซนี่มีการเปลี่ยนแปลง ผู้ใช้บริการต้อง ดำเนินการเปลี่ยนแปลงข้อมูลดังกล่าวโดยพลันตามวิธีการที่โซนี่กำหนด
2-3 ผู้ใช้บริการต้องไม่ใช้บัญชีของผู้ใช้บริการอื่นในการใช้บริการและจะต้องไม่อนุญาตให้บุคคลที่สามใช้บัญชีของผู้ใช้บริการเช่นกัน
2-4 ผู้ใช้บริการต้องจัดการข้อมูลที่เกี่ยวข้องกับบัญชีของตนอย่างเหมาะสม รวมถึงชื่อผู้ใช้และรหัสผ่านผู้ใช้บริการต้องเป็นผู้รับผิดชอบต่อการกระทำและผลลัพท์ของการใช้บริการด้วยบัญชีของผู้ใช้บริการด้วยตัวเอง
2-5 ผู้ใช้บริการอาจยกเลิกบริการ (ลบบัญชีผู้ใช้ดังกล่าว) เมื่อใดก็ได้ตามขั้นตอนที่โซนี่กำหนด เมื่อยกเลิกบริการแล้ว ผู้ใช้บริการจะเสียสิทธิทั้งหมดภายใต้ข้อตกลงการให้บริการนี้ อย่างไรก็ตาม ข้อตกลงการให้บริการนี้จะยังคงมีผลบังคับใช้ต่อผู้ใช้บริการในเรื่องที่เกี่ยวข้องกับการบริการก่อนการยกเลิกบริการ
3. ความเป็นส่วนตัว ข้อมูลของผู้ใช้บริการที่โซนี่ได้รับมาจากบริการจะได้รับการปฏิบัติให้สอดคล้องกับนโยบายความเป็นส่วนตัวของโซนี่
4. เรื่องต้องห้าม
4-1 ในการใช้บริการ ผู้ใช้บริการจะต้องไม่พยายามกระทำหรือกระทำดังต่อไปนี้ และต้องไม่ให้ความร่วมมือหรือสนับสนุนการกระทำดังกล่าวใด ๆ โดยบุคคลที่สาม
(1) การละเมิดสิทธิหรือผลประโยชน์ที่ได้รับการคุ้มครองตามกฎหมาย (รวมถึงสิทธิในทรัพย์สินทางปัญญา ความลับทางการค้า เกียรติยศ สิทธิความเป็นส่วนตัว สิทธิในภาพบุคคล สิทธิในการเผยแพร่ และสิทธิในทรัพย์สิน) ของโซนี่ หรือบุคคลที่สาม
(2) การละเมิดกฎหมาย ข้อบังคับ คำตัดสินของศาล หรือการจัดการที่มีผลผูกพันทางกฎหมายอื่นๆ โดยหน่วยงานรัฐ หรือการกระทำที่ขัดต่อความสงบเรียบร้อยและศีลธรรมของสังคม
(3) การดูหมิ่น หมิ่นประมาท ใส่ร้ายโซนี่หรือบุคคลที่สาม หรือในโดเมนสาธารณะของบริการ หรืออัปโหลดหรือส่งโดยวิธีการอื่นใดซึ่งการแสดงออกหรือข้อมูลอื่น ๆ ที่รวมถึงเนื้อหาที่ไม่เหมาะสมหรือต่อต้านสังคม (รวมถึงการแสดงออกที่รุนแรงเกินเหตุ การแสดงออกทางเพศอย่างโจ่งแจ้ง หรืออาจนำไปสู่การเลือกปฏิบัติ)
(4) การกลั่นแกล้ง การคุกคาม หรือการกระทำอื่นใดที่ขัดขวางการใช้บริการอย่างราบรื่นของผู้ใช้บริการรายอื่น (รวมถึงการส่งข้อมูลเท็จหรือสแปม (spam) หรือขัดขวางการสื่อสารระหว่างผู้ใช้บริการรายอื่น)
(5) การเก็บรวบรวมหรือใช้ หรือการเปิดเผยหรือการจัดหาให้บุคคลที่สาม ซึ่งข้อมูลส่วนบุคคล ข้อมูลที่เกี่ยวข้องกับความเป็นส่วนตัวอื่น ๆ หรือข้อมูลที่เป็นความลับ เช่น รหัสผ่านของผู้อื่น อย่างผิดกฎหมาย
(6) การใช้บริการเพื่อแสวงหากำไร (ยกเว้นที่ได้รับการอนุญาตล่วงหน้าเป็นลายลักษณ์อักษรจากโซนี่) เพื่อพบปะหรือคบหากับคนแปลกหน้าที่เป็นเพศตรงข้าม หรือเพื่อดำเนินการเพื่อวัตถุประสงค์อื่นนอกเหนือจากวัตถุประสงค์ที่แท้จริงของบริการ
(7) การดาวน์โหลด การแจกจ่าย การทำให้สามารถส่งออกสู่สาธารณะ การปรับเปลี่ยน การดำเนินการวิศวกรรมย้อนกลับ การแยกส่วน การแยกชิ้นส่วน การลบ ฯลฯ บริการทั้งหมดหรือส่วนใดส่วนหนึ่งของบริการ นอกเหนือจากขอบเขตที่ได้รับอนุญาตอย่างชัดแจ้งจากโซนี่ (รวมถึงกรณีของการปิดหรือหลีกเลี่ยงการใช้งานฟังก์ชัน เช่น การป้องกันและการควบคุมการเข้าถึงเนื้อหา หรือการจงใจใช้ข้อบกพร่องในบริการในทางที่ผิด)
(8) การรวบรวมหรือปล่อยไวรัส หรือโปรแกรมอื่นๆ หรือไฟล์ที่รบกวนการดำเนินงานที่เหมาะสม ขัดขวาง/ควบคุมการดำเนินงาน หรือเรียกดู/รับ หรือทำลายข้อมูลจากเทอร์มินัลข้อมูล อุปกรณ์ เครือข่าย ระบบ ฯลฯ ที่จัดการโดยโซนี่ หรือบุคคลที่สามเข้าไปยังหรือในเทอร์มินัลข้อมูลดังกล่าว ฯลฯ
(9) การขัดขวางการทำงานที่เป็นปกติและราบรื่นของบริการ เช่น โดยการสร้างภาระที่มากเกินไปบนเซิร์ฟเวอร์ของบริการ หรือโดยการส่งคำร้องที่มากเกินขอบเขตของการใช้สิทธิที่ถูกต้องตามกฎหมายภายใต้ข้อตกลงการให้บริการนี้
(10) การละเมิดอื่น ๆ ของข้อตกลงการให้บริการนี้ หรือ
(11) เรื่องอื่น ๆ ที่โซนี่เห็นว่าไม่เหมาะสม
4-2 หากโซนี่พิจารณาว่าผู้ใช้บริการฝ่าฝืนข้อตกลงการให้บริการนี้ โซนี่อาจระงับหรือลบบัญชีของผู้ใช้บริการดังกล่าว หรือดำเนินการอื่นใด และจะไม่รับผิดชอบใดๆ ต่อกระทำดังกล่าวนั้น
4-3 เว้นแต่กฎหมายจะกำหนดไว้เป็นอย่างอื่น โซนี่ไม่มีภาระผูกพันใดในการเฝ้าติดตามกิจกรรมออนไลน์ของผู้ใช้บริการ เว้นแต่จะกำหนดไว้เป็นอย่างอื่นตามกฎหมาย อย่างไรก็ตาม ตามขอบเขตที่กฎหมายและข้อบังคับอนุญาตและเพื่อวัตถุประสงค์ที่ชอบด้วยกฎหมาย เช่น การตรวจสอบการปฏิบัติตามกฎหมายและข้อตกลงนี้ โซนี่อาจบันทึกกิจกรรมออนไลน์บนบริการและเรียกดูและเปิดเผยกิจกรรมดังกล่าวได้
5. สิทธิในทรัพย์สินทางปัญญา
5-1 สิทธิในทรัพย์สินทางปัญญาและสิทธิอื่น ๆ ที่เกี่ยวข้องกับบริการถือเป็นกรรมสิทธิ์หรืออยู่ภายใต้การควบคุมของโซนี่ หรือผู้ถือสิทธิดั้งเดิมที่อนุญาตสิทธิให้โซนี่ (“ผู้ถือสิทธิดั้งเดิม”)
5-2 การบริการอาจรวมถึงซอฟต์แวร์ที่ผู้ถือสิทธิดั้งเดิมได้กำหนดข้อตกลงที่แตกต่างจากข้อตกลงนี้ไว้ ดังนั้นหากโซนี่แจ้งข้อตกลงการใช้งานดังกล่าวภายใต้การบริการนี้ ให้ผู้ใช้บริการใช้บริการตามข้อตกลงการใช้งานดังกล่าวด้วยเช่นกัน
5-3 ผู้ใช้บริการอนุญาตให้โซนี่ใช้สิทธิโดยไม่เด็ดขาด (รวมถึงอนุญาตให้ช่วงสิทธิดังต่อไปนี้เช่นเดียวกัน) ในการใช้ภาพ เสียง ข้อความหรือข้อมูลอื่นใดที่ผู้ใช้บริการโพสต์หรือส่งโดยเกี่ยวกับบริการ (“เนื้อหาที่โพสต์”) (ทั้งนี้การใช้ ให้รวมถึงการทำซ้ำ การแจกจ่าย การส่งต่อสู่สาธารณะ การละเว้นบางส่วน และการดัดแปลงอื่น ๆ) ในขอบเขตพื้นที่ที่ให้บริการทั้งหมดโดยไม่มีค่าใช้จ่าย โดยโซนี่หรือบุคคลใดๆ ที่โซนี่กำหนด ตามที่กฎหมายที่บังคับใช้อนุญาต ผู้ใช้บริการยินยอมที่จะสละสิทธิหรือไม่ใช้ธรรมสิทธิ์ หรือสิทธิในการเป็นผู้สร้างสรรค์เนื้อหาที่โพสต์ ผู้ใช้บริการมีหน้าที่ที่จะต้องยืนยันว่าเนื้อหาที่โพสต์นั้นไม่ได้ละเมิดสิทธิของบุคคลที่สามและเป็นเนื้อหาที่สอดคล้องกับเนื้อหาของข้อตกลงการให้บริการนี้
5-4 โซนี่อาจดำเนินการใด ๆ เกี่ยวกับเนื้อหาที่โพสต์ใด ๆ ที่โซนี่เห็นว่าละเมิดข้อตกลงนี้หรือไม่เหมาะสม รวมถึงการลบออกจากบริการ โดยไม่ต้องแจ้งให้ผู้ใช้บริการทราบ และโซนี่จะไม่รับผิดต่อผู้ใช้บริการในการกระทำดังกล่าว
6. การเปลี่ยนแปลง ระงับ หรือยกเลิกบริการ
6-1 โซนี่อาจใช้ดุลยพินิจแก้ไขหรือยุติบริการทั้งหมดหรือบางส่วน ซึ่งในการเปลี่ยนแปลงดังกล่าว ผู้ใช้บริการ อาจจำเป็นต้องอัพเดตการบริการ รวมถึงซอฟต์แวร์ อันเป็นเงื่อนไขในการใช้บริการต่อไป
6-2 โซนี่อาจระงับการให้บริการทั้งหมดหรือบางส่วนในช่วงเวลาที่จำเป็น หากมีข้อใดดังต่อไปนี้เกิดขึ้น:
(1) เมื่อการบริการของบุคคลที่สาม (รวมถึงแต่ไม่จำกัดเพียง การบริการโทรคมนาคมและการบริการคลาวด์) ซึ่งจำเป็นต่อการให้บริการหยุดชะงัก
(2) เมื่อมีความจำเป็นที่จะต้องระงับการให้บริการเพื่อดำเนินการบำรุงรักษา และ/หรือการตรวจสอบระบบที่จำเป็นต่อการให้บริการ หรือเพื่อจัดการกับความขัดข้อง ข้อบกพร่องต่าง ๆ ฯลฯ
(3) หากไม่สามารถให้บริการได้เนื่องจากกระแสไฟฟ้าดับ ภัยธรรมชาติข้อพิพาทแรงงานหรือเหตุสุดวิสัย อื่น ๆ หรือ
(4) เมื่อโซนี่เห็นว่าเป็นกรณีที่หลีกเลี่ยงไม่ได้
6-3 โซนี่จะแจ้งให้ผู้ใช้บริการทราบก่อนที่จะมีการเปลี่ยนแปลง ระงับ หรือยุติการบริการทั้งหมดหรือส่วนใดส่วนหนึ่ง หากการเปลี่ยนแปลง การระงับ หรือยุตินั้นจะส่งผลกระทบที่สำคัญต่อผู้ใช้บริการ ยกเว้นในกรณีฉุกเฉิน
6-4 โซนี่จะไม่รับผิดชอบต่อความเสียหายใด ๆ หรือผลกระทบอื่นที่เกิดขึ้นกับผู้ใช้บริการ ที่เกี่ยวข้องกับการเปลี่ยนแปลง ระงับหรือยุติบริการ ยกเว้นในกรณีที่ความเสียหายหรือผลที่ตามมาดังกล่าวเกิดจากความผิดของโซนี่
7. ข้อจำกัดความรับผิดชอบ
7-1 ยกเว้นต้องห้ามโดยกฎหมายที่มีผลบังคับใช้อยู่ โซนี่ไม่รับรองหรือรับประกัน ไม่ว่าโดยชัดแจ้งหรือโดยนัย เกี่ยวกับความถูกต้อง ความปลอดภัย และเรื่องอื่นใดของเนื้อหาของเว็บไซต์และบริการของบุคคลที่สามที่อาจเข้าถึงได้ผ่านลิงก์ของบริการ รวมถึงโฆษณาในบริการ โซนี่จะไม่รับผิดชอบต่อความเสียหายหรือผลกระทบอื่นที่เกิดขึ้นจากการที่ผู้ใช้บริการใช้เว็บไซต์หรือบริการดังกล่าว
7-2 หากมีข้อพิพาทใด ๆ เกิดขึ้นระหว่างผู้ใช้บริการและบุคคลที่สามเนื่องจากการละเมิดสิทธิ หรือกรณีอื่นใดที่เกี่ยวข้องกับการใช้บริการของผู้ใช้บริการในบริการนี้ ผู้ใช้บริการจะต้องยุติข้อพิพาทดังกล่าวด้วยค่าใช้จ่ายและความรับผิดชอบของผู้ใช้บริการเอง และโซนี่จะไม่รับผิดชอบใดๆไม่ว่าในทางใดก็ตาม
7-3 ยกเว้นต้องห้ามโดยกฎหมายที่มีผลบังคับใช้อยู่ โซนี่ไม่รับรองและรับประกัน ไม่ว่าโดยชัดแจ้งหรือโดยนัย ในคุณภาพหรือส่วนอื่นใดของบริการ (รวมถึงข้อบกพร่อง เช่น บั๊ก (bugs) ข้อบกพร่องด้านความปลอดภัย และการละเมิดสิทธิของบุคคลที่สาม)
7-4 แม้ว่าข้อตกลงนี้จะกำหนดไว้เป็นอย่างอื่นและตามที่กฎหมายที่บังคับใช้ให้อนุญาตไว้ ในกรณีที่ผู้ใช้บริการได้รับความเสียหายจากความผิดหรือการละเมิดของโซนี่ โซนี่จะรับผิดชอบต่อความเสียหายดังกล่าวตามความเสียหายที่ตามปกติเกิดขึ้นต่อผู้ใช้บริการเท่านั้น และเป็นจำนวนไม่เกินค่าธรรมเนียมการใช้งานที่โซนี่ได้รับจากผู้ใช้บริการ ทั้งนี้โซนี่จะไม่รับผิดชอบต่อความเสียหายที่ตามมา ความเสียหายทางอ้อมหรือความเสียหายอื่น ๆ ที่เกิดจากพฤติการณ์พิเศษ (ไม่ว่าจะเป็นกรณีที่คาดหมายไว้หรือคาดการณ์ได้ก็ตาม) อย่างไรก็ตามโซนี่จะไม่ได้รับการยกเว้นจากความรับผิดชอบต่อความเสียหายของผู้ใช้บริการเนื่องจากความผิดหรือการละเมิดของโซนี่ อันเป็นผลมาจากการประพฤติมิชอบโดยเจตนาหรือประมาทเลินเล่ออย่างร้ายแรง
7-5 บริการนี้เป็นการให้บริการโดยโซนี่ต่อผู้ใช้บริการภายใต้สัญญาระหว่างโซนี่และผู้ใช้บริการตามข้อตกลงการให้บริการนี้ และผู้ถือสิทธิดั้งเดิมจะไม่รับผิดชอบใดๆต่อผู้ใช้บริการเกี่ยวกับบริการเว้นแต่กฎหมายจะกำหนดไว้เป็นอย่างอื่น
8. การโอนสิทธิ
8-1 ผู้ใช้บริการไม่สามารถโอน ก่อให้เกิดการสืบทอด หรือมอบเพื่อเป็นหลักประกันแก่บุคคลที่สาม ไม่ว่าทั้งหมดหรือบางส่วนซึ่งสถานะหรือสิทธิและภาระผูกพันภายใต้ข้อตกลงนี้
8-2 ผู้ใช้บริการตกลงว่าโซนี่อาจโอนหรือก่อให้เกิดการสืบทอดสถานะหรือสิทธิและภาระผูกพันภายใต้ข้อตกลงนี้ไปยังบุคคลที่สาม และข้อมูลใด ๆ ที่เกี่ยวกับผู้ใช้บริการไปยังบุคคลที่สามที่เกี่ยวข้องกับการโอนหรือการสืบทอดธุรกิจที่เกี่ยวข้องกับบริการนี้ด้วย
9. การเปลี่ยนแปลงข้อตกลงการให้บริการนี้
โซนี่อาจเปลี่ยนแปลงข้อตกลงการให้บริการนี้ได้ตลอดเวลาตามที่กฎหมายกำหนด โซนี่จะแจ้งข้อตกลงที่แก้ไขแล้วผ่านทางเว็บไซต์ของการบริการโดยมีระยะเวลาการแจ้งให้ทราบล่วงหน้าตามที่โซนี่เห็นว่าสมควรสำหรับการเปลี่ยนแปลงนั้น ฯลฯ อย่างไรก็ตามการแจ้งให้ทราบล่วงหน้าดังกล่าวอาจไม่ถูกกำหนดขึ้นหากการเปลี่ยนแปลงนั้นเกี่ยวข้องกับผลประโยชน์โดยทั่วไปของผู้ใช้บริการ
10.การติดต่อสอบถาม
หากผู้ใช้บริการมีคำถามใด ๆ เกี่ยวกับข้อตกลงนี้ ท่านสามารถติดต่อโซนี่โดยใช้แบบฟอร์มการติดต่อบนเว็บไซต์ของการบริการ โซนี่อาจขอยืนยันตัวตนของผู้ใช้บริการโดยวิธีการที่โซนี่กำหนด ทั้งนี้เว้นแต่กฎหมายจะกำหนดไว้เป็นอย่างอื่น โซนี่อาจใช้วิธีการใด ๆ ที่โซนี่เห็นว่าเหมาะสมเพื่อตอบกลับหรือจัดการกับข้อซักถามของผู้ใช้บริการ
11. กฎหมายที่ใช้บังคับและเขตอำนาจศาล
ข้อตกลงนี้อยู่ภายใต้และตีความตามกฎหมายของประเทศญี่ปุ่น ให้ข้อโต้แย้งและข้อพิพาททั้งหมดที่เกิดจากหรือเกี่ยวข้องกับการบริการตัดสินโดยศาลแขวงกรุงโตเกียว (Tokyo District Court) ที่กรุงโตเกียว ประเทศญี่ปุ่น และให้ศาลดังกล่าวเป็นศาลชั้นต้นที่มีอำนาจเด็ดขาดในการตัดสินคดีตามข้อตกลงนี้
12. เบ็ดเตล็ด
12-1 ข้อมูล การแจ้ง หรือการสื่อสารใด ๆ จาก โซนี่ถึงผู้ใช้บริการเกี่ยวกับบริการจะกระทำโดยการโพสต์บนเว็บไซต์ของการบริการหรือวิธีการอื่นใดตามที่โซนี่เห็นว่าเหมาะสม ทั้งนี้โซนี่ไม่รับผิดชอบต่อความเสียหายใด ๆ หรือผลที่ตามมาจากการไม่ส่งมอบหรือความล่าช้าของข้อมูล การแจ้งเตือนหรือการสื่อสารดังกล่าว เว้นแต่ความเสียหายหรือผลกระทบที่เกิดขึ้นนั้นเป็นผลมาจากโซนี่
12-2 หากส่วนใดส่วนหนึ่งของข้อตกลงนี้ไม่มีผล เป็นโมฆะ หรือไม่สามารถบังคับใช้ได้ด้วยเหตุผลใด ๆ ส่วนดังกล่าวจะถูกแยกออกและจะไม่ส่งผลกระทบต่อความมีผลและการบังคับใช้ได้ของส่วนอื่นที่เหลืออยู่
12-3 ให้ผู้ถือสิทธิดั้งเดิมถือเป็นผู้รับผลประโยชน์ที่เป็นบุคคลที่สามของข้อตกลงนี้ และอาจใช้สิทธิที่เกี่ยวข้องหรือสละสิทธิในความรับผิดภายใต้ข้อตกลงนี้ได้โดยตรง

Terms of Service


These Terms of Service (these “Terms”) set forth the terms and conditions of use of the service “Sword Art Online -EX-CHRONICLE- Online Edition” (the “Service”) provided by Sony Music Solutions Inc. (“Sony”) for customers in the Service area (the “Customer”).
Sony may set separate terms and conditions related to the Service (including terms of use to be additionally applied to parts of the Service, operational rules to be separately notified within the Service) (the “Individual Terms”; which shall be deemed to constitute a part of these Terms except when otherwise specifically referred to), and the Customer shall also use the Service in accordance with the Individual Terms. If there is any discrepancy between these Terms and the Individual Terms or the contents of other websites, these Terms shall prevail unless otherwise specified.
If the Customer is a minor in the country or region that the Service is used, such Customer must obtain consent to these Terms from his/her parent or guardian or have the required parent or guardian consent to these Terms on his/her behalf, in accordance with the laws of such country or region, before using the Service.
1. Service
1-1 Related data and documents, etc. and their updated/upgraded versions also constitute part of the Service.
1-2 Sony may place advertisements for Sony and third parties anywhere on the Service.
1-3 An Internet environment is required to use the Service. The Customer shall be responsible for setting up and maintenance of such Internet environment at such Customer’s own expense, including bearing the burden of communication charges and ensuring network security.
1-4 The Service is not intended to be used for the purpose of backup or storage of any data. Sony shall not be liable in any way for loss, alteration or the like of data contained in the Services, or inability to access, use, upload or download data contained in the Services except where tickets, etc. purchased by Customers are lost or otherwise become unable to be used due to reasons attributable to Sony, nor shall Sony be liable in the event of deletion of a user account, or for alteration, interruption or termination of the Services.
1-5 Parts of the Service may be provided for a fee, and prices and payment terms will be announced on the website for the Service. Except as required by law, fees paid for the Service will not be refunded.
2. User Account
2-1 To use the Service, the Customer shall properly provide Sony with the required information and create a user account (the “Account”). The Customer may also create an Account by using a user account for other services (including third party services) designated by Sony. If Sony believes that any of the following applies or the provision of the Service is otherwise impossible or inappropriate, Sony may refuse to create an Account, delete the Account already created or take any other measures that Sony deems appropriate.
(1) If the Customer is a minor in the Service area and has not obtained the consent of a statutory agent or required proxy to use the Service as required under the laws regarding the Service area.
(2) If the Customer provides Sony with information inconsistent with the facts, such as by using another person’s name or making a false statement.
(3) If the Customer has violated these Terms or any applicable laws and regulations during the use of the Service or in the past.
(4) If the Customer falls under the category of an organized crime group, a member of an organized crime group, those who were a member of an organized crime group in the past five years, an associate member of an organized crime group, a racketeer, a group engaging in criminal activities under the pretext of conducting social campaigns, a crime group specialized in intellectual crimes, etc., any other person equivalent to these, a person designated by the Japanese government or a foreign government as subject to economic sanctions, or a resident of a country or region designated by the Japanese government or foreign governments as subject to economic sanctions (collectively “Anti-Social Forces”), or a juridical person which has Anti-Social Forces involved in the management thereof.
(5) If the Customer has already created an Account.
2-2 If any information provided by the Customer to Sony in connection with the use of the Service is changed, the Customer shall carry out the change procedure without delay in the manner prescribed by Sony.
2-3 The Customer shall not use another Customer’s Account to use the Service and shall not allow any third party to use such Customer’s Account.
2-4 The Customer shall properly manage the information related to such Customer’s own Account, including the ID and password. The Customer shall be responsible for all acts and results of using the Service with such Customer’s own Account.
2-5 The Customer may withdraw from the Service (delete such Customer’s Account) at any time through the procedures prescribed by Sony. Upon withdrawal, the Customer shall lose all rights under these Terms; however, these Terms shall continue to apply even after such withdrawal to the matters related to the use of the Service by the Customer prior to the withdrawal.
3. Privacy
The Customer’s information acquired by Sony in connection with the Service shall be treated in accordance with Sony’s Privacy Policy.
4. Prohibited Matters
4-1 In using the Service, the Customer shall not attempt or conduct any of the following acts and shall not cooperate with or promote any of such acts by any third party.
(1) Infringing the rights or legally protected interests (including intellectual property rights, trade secrets, honors, privacy rights, portrait rights, publicity rights and proprietary rights) of Sony or third parties;
(2) Violating laws, regulations, court decisions or other legally binding dispositions by a public authority, or offending public order and morals;
(3) Insulting, defaming, slandering Sony or any third party, or in the public domain of the Service, or uploading or transmitting by other means any expression or other information that includes offensive or antisocial content (including expressions that are excessively violent, explicitly sexual or may lead to discrimination);
(4) Bullying, harassment or any other act of obstructing the smooth use of the Service by other Customers (including sending false information or spam or interfering with the communications of other Customers);
(5) Illegal collection or use, or disclosure or provision to a third party, of personal information, other privacy related information, or confidential information such as passwords, of others;
(6) Using the Service to conduct acts for profit (except where approved in advance in writing by Sony), to meet or socialize with strangers of the opposite sex, or to conduct acts for other purposes different from the intended purpose of the Service;
(7) Downloading, distributing, making available for public transmission, modifying, operating, reverse engineering, decompiling, disassembling, erasing, etc. of all or any part of the Service beyond the scope expressly authorized by Sony (including the case of disabling or avoiding functions such as content protection and access control, or intentionally misusing defects in the Service);
(8) Incorporating or executing viruses or other programs or files that interfere with the proper operation of, obstruct/control the operations of, or browse/acquire or damage the data from, information terminals, network devices, systems, etc. managed by Sony or third parties, into or in such information terminals, etc.;
(9) Impeding the normal and smooth operation of the Service by, for example, imposing an excessive burden on the server of the Service or by making an excessive request beyond the scope of the legitimate exercise of the rights under these Terms;
(10) Any other violation of these Terms; or
(11) Other comparable matters deemed inappropriate by Sony.
4-2 If Sony determines that the Customer is in breach of these Terms, Sony may suspend or delete such Customer’s Account or take any other action and shall have no responsibility whatsoever for such action.
4-3 Unless required otherwise by law, Sony has no obligation to monitor the Customer’s online activities on the Service; provided, however, that, to the extent permitted by laws and regulations and for legitimate purposes such as ensuring compliance with the laws and these Terms, Sony may record online activities on the Service and browse and disclose the same.
5. Intellectual Property Rights
5-1 Intellectual property rights and other rights relating to the Service are owned or controlled by Sony or the original right holder who licensed Sony (the “Original Rights Holder”).
5-2 The Service may include software for which the Original Rights Holder has set different terms of use from these Terms. If Sony notifies such terms of use within the Service, the Customer shall use the Service in accordance with such terms of use as well.
5-3 The Customer hereby grants Sony the non-exclusive right (with the right to sublicense the same) to use any image, sound, text or other information posted or transmitted by the Customer in connection with the Service (the “Posted Content”) (such use includes reproduction, distribution, public transmission, partial omission and other adaptations), in the entire Service area, without charge, by Sony or any party designated by Sony, to the extent permitted by applicable laws. The Customer also agrees to waive or not to exercise any moral rights of the author regarding the Posted Content. It is the Customer’s responsibility to confirm that the Posted Content does not infringe upon the rights of third parties and otherwise conforms to the contents of these Terms.
5-4 Sony may take any action, including deletion from the Service, regarding any Posted Content that Sony deems to be in violation of these Terms or to be inappropriate, without any notice to the Customer. Sony shall not be liable to the Customer for such action.
6. Change, Suspension, Termination of the Service
6-1 Sony may, at its discretion, modify or terminate the Service, in whole or in part. In connection with such modifications, it may be necessary for the Customer to update the Service, including the software therefor, as a condition to continue using the Service.
6-2 Sony may suspend the provision of the Service in whole or in part for the necessary period of time if any of the following applies:
(1)When there is an interruption in the provision of third-party services (including, without limitation, telecommunications services and cloud services) that are necessary to provide the Service;
(2) When it is necessary to suspend the Service in order to perform maintenance and/or inspection of the system necessary for provision of the Service or to deal with its failure, defect, etc.;
(3) If the Service cannot be provided due to a power outage, natural disaster, labor dispute or other force majeure event; or
(4) When Sony deems it unavoidable.
6-3 Except in the case of emergency, Sony will notify the Customer prior to any change, suspension or termination of all or any part of the Service if such change, suspension or termination would have a significant impact on the Customer.
6-4 Sony shall not be liable for any damages or other consequences incurred by the Customer in connection with any change, suspension or termination of the Service, except where such damages or consequences are attributable to Sony.
7. Disclaimer
7-1 Except to the extent prohibited by applicable laws, Sony makes no representation or warranty, either express or implied, with respect to the accuracy, safety and any other matters of the contents of third-party websites and services that may be accessed via a link from the Service, including advertisements on the Service. Sony shall not be liable for any damages or other consequences arising from the Customer’s use of such websites or services.
7-2 If any dispute arises between the Customer and a third party due to infringement of rights or for any other reason in connection with the Customer’s use of the Service, the Customer shall resolve such dispute at his/her own expense and responsibility, and Sony shall not be held liable in any way.
7-3 Except to the extent prohibited by applicable laws, Sony makes no representations and warranties, either express or implied, with respect to the quality or any other aspects of the Service (including defects such as bugs, security defects and infringement of the rights of third parties).
7-4 Notwithstanding any other provision of these Terms, and to the extent permitted by applicable laws, in the event of any damages suffered by the Customer due to Sony’s default or tort, Sony shall be liable for such damages only to the extent of the damage normally incurred by the Customer and up to the total amount of usage fees Sony received from the Customer, and shall not be liable for any consequential damages, indirect damages or other damages arising from special circumstances (including cases that are foreseen or foreseeable). However, Sony will not be exempted from liability for damages of the Customer due to Sony’s default or tort resulting from its willful misconduct or gross negligence.
7-5 The Service is provided by Sony to the Customer under the contract between Sony and the Customer based on these Terms, and the Original Rights Holder shall not be held liable in any way to the Customer regarding the Service, unless otherwise provided by law.
8. Assignment
8-1 The Customer may not assign, cause to be succeeded, or provide for the purpose of collateral to a third party, all or part of the status or rights and obligations under these Terms.
8-2 The Customer agrees that Sony may transfer or cause the succession of the status or rights and obligations under these Terms and any information about the Customers to a third party in connection with the transfer or succession of the business relating to the Services to such third party.
9. Changes to These Terms
Sony may change these Terms at any time to the extent permitted by law. Sony will notify Customers of the revised Terms through the website of the Service with a prior notice period that Sony deems reasonable considering the changes, etc.; provided, however, that such prior notice period may not be set if the changes are in accordance with the general interest of the Customers.
10. Contact for Inquiries
If the Customer has any questions about these Terms, he/she should contact us by using the contact form on the website of the Service. Sony may confirm the identity of the Customer by the method prescribed by Sony. Unless otherwise required by law, Sony may use any method deemed appropriate by Sony to respond to or otherwise cope with Customer inquiries.
11. Governing Law, Jurisdiction, Class or Representative Action Waiver, and Jury Waiver
11-1 These Terms (including any relevant non-contractual obligations) shall be governed by and construed in accordance with the laws of Japan. All controversies and disputes arising out of or relating to the Service (including any relevant non-contractual obligations) shall be submitted to the Tokyo District Court in Tokyo, Japan as the court of exclusive jurisdiction in the first instance.
11-2 By agreeing to these Terms, Customer agrees that Customer is required to resolve any claim that Customer may have against Sony related to the Service or these Terms on an individual basis. Customer agrees to waive any right Customer may otherwise have to bring any class, collective or representative action, and is precluded from participating in or recovering relief under any current or future class, collective, consolidated or representative action against Sony by someone else. Sony and Customer also agree to waive any right to a trial by jury.
12. Miscellaneous
12-1 Any information, notice or communication from Sony to Customers regarding the Service shall be made by posting on the website of the Service or any other method as Sony deems appropriate. If the Customer provides an email address, Customer shall be deemed to have consented to receiving information, notices and communications at that email address, and such electronic delivery will satisfy any legal communication requirements, including that such communications be in writing. Sony shall not be liable for any damages or other consequences of non-delivery or delay of such information, notice or communication, except where such damages or consequences are attributable to Sony.
12-2 If any portion of these Terms is deemed invalid, void or for any reason unenforceable, such portion shall be deemed severable and shall not affect the validity and enforceability of any remaining portion.
12-3 The Original Rights Holder shall be treated as the third-party beneficiary of these Terms and may directly exercise the relevant rights or invoke the waiver of liability under these Terms.
12-4 In addition to the English version, these Terms may be translated into the language of the Service area. If there is any inconsistency in the meaning or wording between the English version and the translated version, the English version shall prevail.

If the Customer is a minor in the country, state or region in which the Service is used, the Customer’s parent or legal guardian must consent to these Terms on behalf of the Customer and authorize the Customer’s creation of an Account (described below) and purchase of tickets through the Service, in accordance with the laws of such country, state or region, before using the Service. A Customer who is a minor agrees that Sony may take steps to verify the contact information or consent provided for a parent or legal guardian.

1-6 The Customer acknowledges and agrees that:
(1) the Service has not been developed to meet the Customer’s individual requirements;
(2) to the extent permitted by applicable laws and regulations, any software or other functionality provided by Sony or any of its third party providers as part of the Service will be provided “as is”;
(3)any systems or devices the Customer may use to access the Service are beyond Sony’s control and Sony shall not be responsible for the operation or security of any such devices or systems;
(4)information and telecommunications systems are not error-free; and
(5)the provision of any internet-based service may be subject to disruption.
2. User Account
2-1 To use the Service, the Customer shall properly provide Sony with the required information and create a user account (the “Account”). By registering and creating an Account, the Customer agrees that they have read, understood, and accept all of the terms and conditions contained in these Terms, as well as Sony’s Privacy Policy and Cookie Policy. The Customer may also create an Account by using a user account for other services (including third party services) designated by Sony. If Sony believes that any of the following applies or the provision of the Service is otherwise impossible or inappropriate, Sony may refuse to create an Account, delete the Account already created or take any other measures that Sony deems appropriate.
(1) If the Customer is a minor and a parent or legal guardian has not consented the Customer’s use of the Service or these Terms pursuant to the laws applicable where the minor is using the Service;
(2) If the Customer provides Sony with information inconsistent with the facts, such as by using another person’s name or making a false statement.
(3) If the Customer has violated these Terms or any applicable laws and regulations during the use of the Service or in the past.
(4) If the Customer falls under the category of an organized crime group, a member of an organized crime group, those who were a member of an organized crime group in the past five years, an associate member of an organized crime group, a racketeer, a group engaging in criminal activities under the pretext of conducting social campaigns, a crime group specialized in intellectual crimes, etc., any other person equivalent to these, a person designated by the Japanese government or a foreign government as subject to economic sanctions, or a resident of a country or region designated by the Japanese government or foreign governments as subject to economic sanctions (collectively “Anti-Social Forces”), or a juridical person which has Anti-Social Forces involved in the management thereof.
(5) If the Customer has already created an Account.
2-2 The Customer shall ensure that any information provided by the Customer to Sony, including any contact details, remains up-to-date and accurate. If any information provided by the Customer to Sony in connection with the use of the Service is changed, the Customer shall update the relevant information without delay. If the Customer does not receive a message from Sony because their contact details are incorrect or out of date, Sony shall still be deemed to have notified the Customer.
2-3 The Customer shall not use another Customer’s Account to use the Service and shall not allow any third party to use such Customer’s Account.
2-4 The Customer shall properly manage the information related to such Customer’s own Account, including the ID and password. The Customer shall be responsible for all acts and results of using the Service with such Customer’s own Account.
2-5 The Customer may withdraw from the Service (delete such Customer’s Account) at any time through the procedures prescribed by Sony. Upon withdrawal, the Customer shall lose all rights under these Terms and Sony may disable, reclaim and reuse the Customer’s Account name and other identifiers they have adopted within the Service; however, these Terms shall continue to apply even after such withdrawal to the matters related to the use of the Service by the Customer prior to the withdrawal.
3. Privacy and Cookies
3-1 The Customer’s information acquired by Sony in connection with the Service shall be treated in accordance with Sony’s Privacy Policy.
3-2 The Service uses cookies. For more information, please refer to Sony’s Cookie Policy.
3-3 The Customer grants Sony a non-exclusive, perpetual, royalty-free, transferable, sublicensable, worldwide, irrevocable and unrestricted licence to use all information provided by the Customer to Sony when using the Service (including any data) and all information relating to activities on the Service.
4. Prohibited Matters
4-1 In using the Service, the Customer shall not attempt or conduct any of the following acts and shall not cooperate with or promote any of such acts by any third party.

4-2 If Sony determines that the Customer is in breach of these Terms, Sony may suspend or delete such Customer’s Account or take any other action and shall have no responsibility whatsoever for such action.
4-3 Unless required otherwise by law, Sony has no obligation to monitor the Customer’s online activities on the Service; provided, however, that, to the extent permitted by laws and regulations and for legitimate purposes such as ensuring compliance with the laws and these Terms, Sony may monitor online activities on the Service and browse and disclose the same in accordance with its Privacy Policy.
5. Intellectual Property Rights

5-4 Sony may take any action, including deletion from the Service, regarding any Posted Content that Sony deems to be in violation of these Terms or to be inappropriate, without any notice to the Customer. Sony shall not be liable to the Customer for such action.
6. Change, Suspension, Termination of the Service
6-1 Sony may, at its discretion, modify or terminate the Service, in whole or in part. In connection with such modifications, it may be necessary for the Customer to update the Service, including the software therefor, as a condition to continue using the Service.
6-2 Sony may suspend the provision of the Service in whole or in part for the necessary period of time if any of the following applies:

6-3 Except in the case of emergency, Sony will notify the Customer prior to any change, suspension or termination of all or any part of the Service if such change, suspension or termination would have a significant impact on the Customer.
6-4 Sony shall not be liable for any damages or other consequences incurred by the Customer in connection with any change, suspension or termination of the Service, except where such damages or consequences are attributable to Sony.
6-5 The Customer shall have the right to cancel a purchased ticket and receive a full refund from Sony in respect of a ticket purchase for an event hosted by the Service, within 14 days of the Customer making the ticket purchase provided they have not viewed or accessed the relevant event prior to their request to cancel. The Customer acknowledges and agrees that if they view or access the relevant event prior to the end of said 14 day cancellation period, they will waive their 14 day right to cancel under this section 6-5 in order view such event. Notwithstanding the foregoing, if the ticket in question is a ticket to view an event (and/or a recording of such event) on a single occasion on a specific date, then the Customer shall not have the right to cancel the purchase of such ticket under this section 6-5.
7. Disclaimer
7-1 Except to the extent prohibited by applicable laws, Sony makes no representation or warranty, either express or implied, with respect to the accuracy, safety and any other matters of the contents of third-party websites and services that may be accessed via a link from the Service, including advertisements on the Service. Sony shall not be liable for any damages or other consequences arising from the Customer’s use of such websites or services.
7-2 If any dispute arises between the Customer and a third party due to infringement of rights or for any other reason in connection with the Customer’s use of the Service, the Customer shall resolve such dispute at his/her own expense and responsibility, and Sony shall not be held liable in any way.
7-3 Except to the extent prohibited by applicable laws, Sony makes no representations and warranties, either express or implied, in respect of the Service (including security defects and infringement of the rights of third parties). Notwithstanding the foregoing, if the Service is faulty or misdescribed, the Customer may ask Sony to (i) repair; or (ii) replace the relevant element of, the Service in the first instance.
7-4 Notwithstanding any other provision of these Terms, and to the extent permitted by applicable laws, in the event of any damages suffered by the Customer due to Sony’s default or tort, Sony shall be liable for such damages only to the extent of the damage normally incurred by the Customer and up to the total amount of usage fees Sony received from the Customer, and shall not be liable for any losses (i) that were not foreseeable by either party when the Customer agrees to these Terms; (ii) not caused by a breach on Sony’s part; or (iii) which are business (including a loss of business opportunities) and/or non-consumer losses. However, Sony will not be exempted from liability for damages of the Customer due to Sony’s default or tort resulting from its willful misconduct or gross negligence. Sony also does not exclude any liability for (i) death or personal injury caused by Sony’s negligence; and (ii) breach of the Customer’s legal rights in relation to the Service, including breach of any terms, legal quality standards or legal rules under, or implied by, applicable consumer rights laws in the Customer’s Service area.
7-5 The Service is provided by Sony to the Customer under the contract between Sony and the Customer based on these Terms, and the Original Rights Holder shall not be held liable in any way to the Customer regarding the Service, unless otherwise provided by law.
8. Assignment
8-1 The Customer may not assign, cause to be succeeded, or provide for the purpose of collateral to a third party, all or part of the status or rights and obligations under these Terms.
8-2 The Customer agrees that Sony may transfer or cause the succession of the status or rights and obligations under these Terms and any information about the Customers to a third party in connection with the transfer or succession of the business relating to the Services to such third party.
9. Changes to These Terms
Sony may change these Terms at any time to the extent permitted by law. Sony will notify the revised Terms through the website of the Service with a prior notice period that Sony deems reasonable considering the changes, etc.; provided, however, that such prior notice period may not be set if the changes are required by law. The Customer shall be responsible for reviewing and becoming familiar with any changes. By continuing to access and use the Service following the changes the Customer agrees to those changes to these Terms.
10. Contact for Inquiries
If the Customer has any questions about these Terms, he/she should contact us by using the contact form on the website of the Service. Sony may confirm the identity of the Customer by the method prescribed by Sony. Unless otherwise required by law, Sony may use any method deemed appropriate by Sony to respond to or otherwise cope with Customer inquiries.
11. Governing Law and Jurisdiction
These Terms (including any relevant non-contractual obligations) shall be governed by and construed in accordance with the laws of Japan. All controversies and disputes arising out of or relating to the Service (including any relevant non-contractual obligations) shall be submitted to the Tokyo District Court in Tokyo, Japan as the court of exclusive jurisdiction in the first instance. Nothing in these Terms will reduce any applicable statutory rights the Customer has (including any rights under applicable consumer rights laws in the Customer’s Service area).
12. Miscellaneous
12-1 Any information, notice or communication from Sony to Customers regarding the Service shall be made by posting on the website of the Service or any other method as Sony deems appropriate. Sony shall not be liable for any damages or other consequences of non-delivery or delay of such information, notice or communication, except where such damages or consequences are attributable to Sony.
12-2 If any portion of these Terms is deemed invalid, void or for any reason unenforceable, such portion shall be deemed severable and shall not affect the validity and enforceability of any remaining portion.
12-3 The Original Right Holder shall be treated as the third-party beneficiary of these Terms and may directly exercise the relevant rights or invoke the waiver of liability under these Terms. Except for the Original Right Holder and any permitted parties, no term of these Terms shall be enforceable by any person who is not a party to these Terms under applicable third party rights legislation.
12-4 In addition to the English version, these Terms may be translated into the language of the Service area. If there is any inconsistency in the meaning or wording between the English version and the translated version, the English version shall prevail.

Terms of Service


Effective Date: December 4th, 2021
These Terms of Service (these “Terms”) set forth the terms and conditions of use of the service “ Sword Art Online -EX-CHRONICLE- Online Edition” (the “Service”) provided by Sony Music Solutions Inc. (“Sony”) for customers in the Service area, which includes the United States (the “Customer”). Sony and Customer may be referred to as a “party” or, collectively, as the “parties.” By accessing or using the Service, Customers agree to these Terms. Customers acknowledge their consent to these Terms by checking the “I agree with the latest Terms of Service” checkbox.
Sony may set separate terms and conditions related to the Service (including terms of use to be additionally applied to parts of the Service, operational rules to be separately notified within the Service) (the “Individual Terms,” which shall be deemed to constitute a part of these Terms except when otherwise specifically referred to), and the Customer shall also use the Service in accordance with the Individual Terms. If there is any discrepancy between these Terms and the Individual Terms or the contents of other websites, these Terms shall prevail unless otherwise specified.
The Service is not intended for children under the age of 13 years, and they are not eligible to use the Service. If the Customer is a minor in the country, state or region in which the Service is used, the Customer’s parent or guardian must consent to these Terms on behalf of the Customer and authorize the Customer’s creation of an Account (described below) and purchase of tickets through the Service, in accordance with the laws of such country, state or region, before using the Service. A Customer who is a minor agrees that Sony may take steps to verify the contact information or consent provided for a parent or guardian.
1. Service
1-1 Related data and documents, etc. and their updated/upgraded versions also constitute part of the Service.
1-2 Sony may place advertisements for Sony and third parties anywhere on the Service.
1-3 An Internet environment is required to use the Service. The Customer shall be responsible for setting up and maintenance of such Internet environment at such Customer’s own expense, including bearing the burden of communication charges and ensuring network security.
1-4 The Service is not intended to be used for the purpose of backup or storage of any data. Sony shall not be liable in any way for loss, alteration or the like of data contained in the Services, or inability to access, use, upload or download data contained in the Services except where tickets, etc. purchased by Customers are lost or otherwise become unable to be used due to reasons attributable to Sony, nor shall Sony be liable in the event of deletion of a user account, or for alteration, interruption or termination of the Services.
1-5 Parts of the Service may be provided for a fee, and prices and payment terms will be announced on the website for the Service. Except as required by law, fees paid for the Service will not be refunded.
2. User Account
2-1 To use the Service, the Customer shall properly provide Sony with the required information and create a user account (the “Account”). The Customer may also create an Account by using a user account for other services (including third party services) designated by Sony. If Sony believes that any of the following applies or the provision of the Service is otherwise impossible or inappropriate, Sony may refuse to create an Account, delete the Account already created or take any other measures that Sony deems appropriate.
(1) If the Customer is a minor and a parent or guardian has not consented the Customer’s use of the Service or these Terms pursuant to the laws applicable where the minor is using the Service.
(2) If the Customer provides Sony with information inconsistent with the facts, such as by using another person’s name or making a false statement.
(3) If the Customer has violated these Terms or any applicable laws and regulations during the use of the Service or in the past.
(4) If the Customer falls under the category of an organized crime group, a member of an organized crime group, those who were a member of an organized crime group in the past five years, an associate member of an organized crime group, a racketeer, a group engaging in criminal activities under the pretext of conducting social campaigns, a crime group specialized in intellectual crimes, etc., any other person equivalent to these, a person designated by the Japanese government or a foreign government as subject to economic sanctions, or a resident of a country or region designated by the Japanese government or foreign governments as subject to economic sanctions (collectively “Anti-Social Forces”), or a juridical person which has Anti-Social Forces involved in the management thereof.
(5) If the Customer has already created an Account.
2-2 If any information provided by the Customer to Sony in connection with the use of the Service is changed, the Customer shall carry out the change procedure without delay in the manner prescribed by Sony.
2-3 The Customer shall not use another Customer’s Account to use the Service and shall not allow any third party to use such Customer’s Account.
2-4 The Customer shall properly manage the information related to such Customer’s own Account, including the ID and password. The Customer shall be responsible for all acts and results of using the Service with such Customer’s own Account.
2-5 The Customer may withdraw from the Service (delete such Customer’s Account) at any time through the procedures prescribed by Sony. Upon withdrawal, the Customer shall lose all rights to access and use the Service; however, these Terms shall continue to apply even after such withdrawal to the matters related to the use of the Service by the Customer prior to the withdrawal. Fees paid prior to withdrawal will not be refunded, except as required by law.
3. Privacy
The Customer’s information acquired by Sony in connection with the Service shall be treated in accordance with Sony’s Privacy Policy.
4. Prohibited Matters
4-1 In using the Service, the Customer shall not attempt or conduct any of the following acts and shall not cooperate with or promote any of such acts by any third party.
(1) Infringing the rights or legally protected interests (including intellectual property rights, trade secrets, honors, privacy rights, portrait rights, publicity rights and proprietary rights) of Sony or third parties;
(2) Violating laws, regulations, court decisions or other legally binding dispositions by a public authority, or offending public order and morals;
(3) Insulting, defaming, slandering Sony or any third party, or in the public domain of the Service, or uploading or transmitting by other means any expression or other information that includes offensive or antisocial content (including expressions that are excessively violent, explicitly sexual or may lead to discrimination);
(4) Bullying, harassment or any other act of obstructing the smooth use of the Service by other Customers (including sending false information or spam or interfering with the communications of other Customers);
(5) Illegal collection or use, or disclosure or provision to a third party, of personal information, other privacy related information, or confidential information such as passwords, of others;
(6) Using the Service to conduct acts for profit (except where approved in writing in advance by Sony), to meet or socialize with strangers of the opposite sex, or to conduct acts for other purposes different from the intended purpose of the Service;
(7) Downloading, distributing, making available for public transmission, modifying, operating, reverse engineering, decompiling, disassembling, erasing, etc. of all or any part of the Service beyond the scope expressly authorized by Sony (including the case of disabling or avoiding functions such as content protection and access control, or intentionally misusing defects in the Service);
(8) Incorporating or executing viruses or other programs or files that interfere with the proper operation of, obstruct/control the operations of, or browse/acquire or damage the data from, information terminals, network devices, systems, etc. managed by Sony or third parties, into or in such information terminals, etc.;
(9) Impeding the normal and smooth operation of the Service by, for example, imposing an excessive burden on the server of the Service or by making an excessive request beyond the scope of the legitimate exercise of the rights under these Terms;
(10) Any other violation of these Terms; or
(11) Other matters deemed inappropriate by Sony.
4-2 If Sony determines that the Customer is in breach of these Terms, Sony may suspend or delete such Customer’s Account or take any other action and shall have no responsibility whatsoever for such action.
4-3 Unless required otherwise by law, Sony has no obligation to monitor the Customer’s online activities on the Service; provided, however, that, to the extent permitted by laws and regulations and for legitimate purposes such as ensuring compliance with the laws and these Terms, Sony may record online activities on the Service and browse and disclose the same.
5. Intellectual Property Rights
5-1 Intellectual property rights and other rights relating to the Service are owned or controlled by Sony or the original right holder who licensed Sony (the “Original Rights Holder”).
5-2 The Service may include software for which the Original Rights Holder has set different terms of use from these Terms. If Sony notifies such terms of use within the Service, the Customer shall use the Service in accordance with such terms of use as well.
5-3 The Customer hereby grants Sony the non-exclusive right (with the right to sublicense the same) to use any image, sound, text or other information posted or transmitted by the Customer in connection with the Service (the “Posted Content”) (such use includes reproduction, distribution, public transmission, partial omission and other adaptations), without charge, by Sony or any party designated by Sony, to the extent permitted by applicable laws. Customer also agrees to waive or not to exercise any moral rights of the author regarding the Posted Content. It is the Customer’s responsibility to confirm that the Posted Content does not infringe upon the rights of third parties and otherwise conforms to the contents of these Terms.
5-4 Sony may take any action, including deletion from the Service, regarding any Posted Content that Sony deems to be in violation of these Terms or to be inappropriate, without any notice to the Customer. Sony shall not be liable to the Customer for such action.
6. Change, Suspension, Termination of the Service
6-1 Sony may, at its discretion, modify or terminate the Service, in whole or in part. In connection with such modifications, it may be necessary for the Customer to update the Service, including the software therefor, as a condition to continue using the Service.
6-2 Sony may suspend the provision of the Service in whole or in part for the necessary period of time if any of the following applies:
(1) When there is an interruption in the provision of third-party services (including, without limitation, telecommunications services and cloud services) that are necessary to provide the Service;
(2) When it is necessary to suspend the Service in order to perform maintenance and/or inspection of the system necessary for provision of the Service or to deal with its failure, defect, etc.;
(3) If the Service cannot be provided due to a power outage, natural disaster, labor dispute or other force majeure event; or
(4) When Sony deems it unavoidable.
6-3 Except in the case of emergency, Sony will notify the Customer prior to any change, suspension or termination of all or any part of the Service if such change, suspension or termination would have a significant impact on the Customer.
6-4 Sony shall not be liable for any damages or other consequences incurred by the Customer in connection with any change, suspension or termination of the Service, except where such damages or consequences are attributable to Sony.
7. Disclaimer
7-1 Except to the extent prohibited by applicable laws, Sony makes no representation or warranty, either express or implied, with respect to the accuracy, safety and any other matters of the contents of third-party websites and services that may be accessed via a link from the Service, including advertisements on the Service. Sony shall not be liable for any damages or other consequences arising from the Customer’s use of such websites or services.
7-2 If any dispute arises between the Customer and a third party due to infringement of rights or for any other reason in connection with the Customer’s use of the Service, the Customer shall resolve such dispute at his/her own expense and responsibility, and Sony shall not be held liable in any way.
7-3 Except to the extent prohibited by applicable laws, Sony makes no representations and warranties, either express or implied, with respect to the quality or any other aspects of the Service (including defects such as bugs, security defects and infringement of the rights of third parties).
7-4 Notwithstanding any other provision of these Terms and to the extent permitted by applicable laws, in the event of any damages suffered by the Customer due to Sony’s default or tort, Sony shall be liable for such damages only to the extent of the damage normally incurred by the Customer and up to the total amount of usage fees Sony received from the Customer, and shall not be liable for consequential damages, indirect damages or other any damages arising from special circumstances (including cases that are foreseen or foreseeable). However, Sony will not be exempted from liability for damages of the Customer due to Sony’s default or tort resulting from its willful misconduct or gross negligence, or for Customers who are residents of New Jersey, USA.
7-5 The Service is provided by Sony to the Customer under the contract between Sony and the Customer based on these Terms, and the Original Rights Holder shall not be held liable in any way to the Customer regarding the Service, unless otherwise provided by law.
8. Assignment
8-1 The Customer may not assign, cause to be succeeded, or provide for the purpose of collateral to a third party, all or part of the status or rights and obligations under these Terms.
8-2 The Customer agrees that Sony may transfer or cause the succession of the status or rights and obligations under these Terms and any information about the Customers to a third party in connection with the transfer or succession of the business relating to the Services to such third party.
9. Changes to These Terms
Sony may change these Terms at any time to the extent permitted by law. Sony will notify Customers of the revised Terms through the website of the Service with a prior notice period that Sony deems reasonable considering the changes, etc.; provided, however, that such prior notice period may not be set if the changes are in accordance with the general interest of the Customers.

If the Customer has any questions about these Terms, he/she should contact us by using the contact form on the website of the Service. Sony may confirm the identity of the Customer by the method prescribed by Sony. Unless otherwise required by law, Sony may use any method deemed appropriate by Sony to respond to or otherwise cope with Customer inquiries.
11. Governing Law, Jurisdiction, Binding Arbitration, Class or Representative Action Waiver, and Jury Waiver
11-1 Class Action/Representative Action Waiver and Jury Trial Waiver. By agreeing to these Terms, Customer agrees that Customer is required to resolve any claim that Customer may have against Sony related to the Service or these Terms on an individual basis. Customer agrees to waive any right Customer may otherwise have to bring any class, collective or representative action, and is precluded from participating in or recovering relief under any current or future class, collective, consolidated or representative action against Sony by someone else. Sony and Customer also agree to waive any right to a trial by jury.
11-2 Tokyo Dispute Proceedings. These Terms shall be governed by and construed in accordance with the laws of Japan. All controversies and disputes arising out of or relating to the Service shall be submitted to the Tokyo District Court in Tokyo, Japan as the court of exclusive jurisdiction in the first instance.
11-3 Binding Arbitration. If either a Customer or Sony elects in writing, or if a court deems the choice of law and jurisdiction clause in Section 11.2 unenforceable, then these Terms shall be governed by the laws of the State of Delaware, United States, and any disputes arising out of or relating to the Service shall be resolved through binding arbitration pursuant to this Section 11.3. The arbitration shall take place in the state in the United States where the Customer was a resident when the dispute arose, or other location mutually agreed by the parties.
11-3-1 The arbitration will be conducted by the American Arbitration Association (referred to as the “AAA”) under its rules and procedures, including the AAA's Consumer Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes (the “AAA Rules”) (as applicable), as modified by this Agreement to Arbitrate. The AAA Rules are available at www.adr.org. Notwithstanding any choice of law or other provision in these Terms, the parties agree and acknowledge that this Agreement to Arbitrate evidences a transaction involving interstate commerce and that the Federal Arbitration Act, 9 U.S.C. § 1 et seq. (“FAA”), will govern its interpretation and enforcement and proceedings pursuant thereto. It is the intent of the parties that the FAA and AAA Rules shall preempt all state laws to the fullest extent permitted by law. If the FAA and AAA Rules are found to not apply to any issue that arises under this Agreement to Arbitrate or the enforcement thereof, then that issue shall be resolved under the laws of the state of Delaware. A party who intends to seek arbitration must first send the other party, by certified mail, a completed Notice of Dispute. Customer should send this notice to Sony at Midtown Tower, 9-7-1, Akasaka, Minato-ku, Tokyo, 107-6214 Japan. Sony will send any notice to Customer to the address Sony has on file associated with Customer. It is Customer’s responsibility to keep Customer’s address up to date. All information called for in the notice must be provided including a description of the nature and basis of the claims the party is asserting and the relief sought.
11-3-2 If Customer and Sony are unable to resolve the claims described in the notice within 30 days after the notice is sent, Customer or Sony may initiate arbitration proceedings. A form for initiating arbitration proceedings is available on the AAA's website at www.adr.org. Unless both Customer and Sony agree otherwise, the arbitrator(s) may not consolidate or join more than one person’s or party’s claims and may not otherwise preside over any form of a consolidated, representative, collective or class proceeding.
11-3-3 If the value of the relief sought is $10,000 or less, Customer or Sony may elect to have the arbitration conducted by telephone or based solely on written submissions, which election shall be binding on Customer and Sony subject to the discretion of the arbitrator(s) to require an in-person hearing, if the circumstances warrant.  In cases where an in-person hearing is held, Customer or Sony may attend by telephone, unless the arbitrator(s) require otherwise. Any settlement offer made by Customer or Sony shall not be disclosed to the arbitrator(s).
11-3-4 The arbitrator(s) will decide the substance of all claims in accordance with applicable law, including recognized principles of equity, and will honor all claims of privilege recognized by law. The arbitrator(s) will not be bound by rulings in prior arbitrations involving different customers of Sony but is/are bound by rulings in prior arbitrations involving the same Customer to the extent required by applicable law. The award of the arbitrator(s) shall be final and binding, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitrator(s) may aware relief (including monetary, injunctive and declaratory) only in favor of the individual party seeking relief and only to the extent necessary to provide relief necessitated by that party’s individual claim(s). Any relief awarded cannot affect any other Sony customers.
11-3-5 Payment of all filing, administration, and arbitrator fees will be governed by the AAA's rules, unless otherwise stated in this Agreement to Arbitrate. If the value of the relief sought is $10,000 or less, at Customer’s request, Sony will pay all filing, administration, and arbitrator fees associated with the arbitration. Any request for payment of fees by Sony should be submitted by mail to the AAA along with Customer’s Demand for Arbitration and Sony will make arrangements to pay all necessary fees directly to the AAA. If the value of the relief sought is more than $10,000 and Customer is able to demonstrate that the costs of accessing arbitration will be prohibitive as compared to the costs of accessing a court for purposes of pursuing litigation on an individual basis, Sony will pay as much of the filing, administration, and arbitrator fees as the arbitrator(s) deem necessary to prevent the cost of accessing the arbitration from being prohibitive. In the event the arbitrator(s) determine the claim(s) Customer asserts in the arbitration to be frivolous, Customer agrees to reimburse Sony for all fees associated with the arbitration paid by Sony on Customer’s behalf that Customer otherwise would be obligated to pay under the AAA's rules.
11-3-6 If a court decides that any part of the agreement to arbitrate in this Section 11.3 is invalid or unenforceable, the other parts of Section 11.3 shall still apply.
12. Miscellaneous
12-1 Any information, notice or communication from Sony to Customers regarding the Service shall be made by posting on the website of the Service or any other method as Sony deems appropriate. If the Customer provides an email address, Customer shall be deemed to have consented to receiving information, notices and communications at that email address, and such electronic delivery will satisfy any legal communication requirements, including that such communications be in writing. Sony shall not be liable for any damages or other consequences of non-delivery or delay of such information, notice or communication, except where such damages or consequences are attributable to Sony.
12-2 If any portion of these Terms is deemed invalid, void or for any reason unenforceable, such portion shall be deemed severable and shall not affect the validity and enforceability of any remaining portion.
12-3 The Original Rights Holder shall be treated as the third-party beneficiary of these Terms and may directly exercise the relevant rights or invoke the waiver of liability under these Terms.
12-4 These Terms may be translated into the language of other countries or regions in the Service area. If there is any inconsistency in the meaning or wording between the English version and the translated version, the English version shall prevail.
12-5 Customers who are residents of California, United States, and require consumer assistance may contact Sony at Midtown Tower, 9-7-1 Akasaka, Minato-ku, Tokyo, 107-6214 Japan, or by telephone at +1 833-470-0771. California resident Customers may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Sacramentao, CA 95834, or by telephone at 916-445-1254 or 800-952-5210.
13. Minors – Removal of Postings
13-1 A Customer who is a minor and a resident of California, United States, may remove any content that the Customer has posted on the Service that is accessible by another user, or may request that Sony remove the content. To make a request, the minor Customer California resident should send the request to/s/excglb/form/inquiry?ima=4820
13-2 Minor Customers must understand that removal of the publicly available content does not ensure complete or comprehensive removal of the content or information.
